HomeMy WebLinkAboutOrdinance 2004 (665) ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG: RESIDENTIAL ORDINANCE NO. (C■S GI OVA) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of GREGORY AND LINDA NELSON on June 23, 2004, in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 80 acres of land located in the W %2 of the SE 1/4, Section 1, T31N- R19W,Town of Somerset. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. There are probable sand and gravel deposits under 1 /4 of the site. 3. Surrounding zoning is exclusive ag to the north, west and south and ag residential to the east. 4. The site has access to County Road H to the south. 5. Proposed use is a 24 -lot subdivision . 6. The Town of Somerset has recommended approval of the rezoning, and states that the rezoning does comply with Wisconsin Statutes Chapter 91 and the Town Comprehensive Plan. 7. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan. 8. The area is in proximity to some existing development. 9. The parcel's terrain is suitable for development. 10. The area is not located in the southern part of the town. 11. The area is adjacent to or in proximity to rivers, wetlands, lakes and conservancy areas. 12. Justify non - agricultural uses on land in the agriculture district. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 80 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
