CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AG- RESIDENTIAL TO COMMERCIAL ORDINANCE NO._ (de OA) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of RANDY AND DEBBIE CALLEJA on June 23, 2004, in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED LEGAL FOR 4.00 ACRES Based on the following findings: 1. The land is in the rural planning area and may be an appropriate use. 2. None of the parcel is identified on the primary environmental corridor map. 3. None of the site has limiting soils for Private Onsite Wastewater Treatment (POWTS). 4. There are probable gravel deposits under half this site and there are probable sand deposits under all this site. 5. Surrounding land uses are commercial to the north and northwest, large -lot residential to the west and agriculture to the east and south. 6. The neighboring commercial uses are a small office structure to the north and a mini - storage structure to the northwest. 7. Surrounding zoning is commercial to the north and northwest and ag residential to the west, south and east. 8. Site is located on County Trunk Highway G and STH 65. The existing access on CTH G would be utilized. 9. Proposed use of the site is to construct a banquet hall facility with parking and outdoor seating. The existing house would be utilized in conjunction with the banquet hall for guest lodging. 10. Potential development is two commercial uses. 11. The rezoning is somewhat consistent with the County Plan. The County Plan states "Commercial uses in the Rural Planning Area should be located to serve rural residential neighborhoods or on state or federal highways to serve the traveling public "... "These uses shall be provided for in locally adopted plans and where sufficient infrastructure is available or provided to accommodate the proposed development." 12. The Town of Richmond has recommended approval of the rezoning. With the following conditions: 1. A 66 -foot access to be constructed to Lot 4 as per the St. Croix County Highway Department. 2. Access to Lot 3 must be greater than 200 -feet from the centerline of County Road "G ". 3. A grading and drainage plan must be developed and approved before construction. 4. Dedication of the town road must be made to a point even with the south property line of the applicant's property. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 4 -acre parcel in the Town of Richmond is now rezoned from Ag- Residential to Commercial.
