ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. 67 � " 9 ( 1) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of JAMES A. AND BARB L. NELSON on May 5, 2004, in the St. Croix Agricultural Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: That part of the Southeast Quarter of Southwest quarter (SE 1/4 of SW 1/4) and Southwest Quarter of Southeast Quarter (SW 1/4 of SE 1/4), Section Five (5), Township Thirty -one (31) North of Range Nineteen (19) West, Lying East of Certified Survey Map filed August 20, 1985, in volume 6 of Certified Survey Maps on page 1568 as Document No. 404467; Somerset Township, in St. Croix County, Wisconsin. Parcel contains 43 acres more or less. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The site consists of open rolling land, approximately half farm field and half pasture. 3. There are probable sand and gravel deposits under the whole site. 4. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the site. 5. The site has access to town a town road, 230 Avenue, to the south. 6. The Town of Somerset has recommended approval of the rezoning and states that the rezoning does comply with the Wisconsin Statutes Chapter 91 and the Town Comprehensive Plan. 7. The rezoning is generally consistent with the Town Plan. 8. The area is not adjacent to or in proximity to rivers, wetlands, lakes and conservancy areas. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 43 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
