DELEGATING POWER TO ACQUIRE, MANAGE, AND
SELL TAX- DEEDED LANDS

WHEREAS, St. Croix County Code Chapter 3, pursuant to Wisconsin Statutes sec. 75.35(2)(d),
delegates to the Finance Committee the authority to acquire, manage and sell tax- deeded land in
accordance with Wisconsin Statutes sec. 75.69(1); and
WHEREAS, prior to February 20, 2004, if a county desired to sell tax - deeded land, sec. 75.69(1)
required the land to be advertised for sale and to be sold at no less than its appraised value; and
WHEREAS, if the county did not receive any bids for at least the appraised value, the county
could not sell the tax- deeded land; and
WHEREAS, on February 20, 2004, amendments to sec. 75.69(1), changing the process for
selling tax - deeded property, became effective; and
WHEREAS, the amendments allow a county to sell tax - deeded lands at less than the appraised
value if, after failing to receive an initial bid of at least the appraised value, the county
readvertises the tax- deeded land for sale and the county board or a committee designated by the
county board reviews and approves such a sale; and
WHEREAS, St. Croix County Code Chapter 3, sec. 3.4 reads,
"4. The Finance Committee is authorized to sell tax- deeded land, following the
procedures in Wisconsin Statutes section 75.35 and section 75.69, including sale
by land contract, or quit -claim deed or warranty deed with a mortgage from the
purchaser, without County Board approval."
; and
WHEREAS, St. Croix County Code Chapter 3, sec. 3.5 reads,
"5. The Finance Committee may retain licensed appraisers to determine the value
of tax- deeded land and licensed real estate brokers or salespersons to assist in
selling tax- deeded land, and to pay fees or commissions for such service."
THEREFORE, the Board of Supervisors of the County of St. Croix does ordain as follows:
Chapter 3, Ordinance Delegating Powers to Acquire, Manage, and Sell Tax -Deed Lands, 3.
Procedures, is amended to read as follows:

"4. The Finance Committee is authorized to sell tax - deeded land without Board
of Supervisors approval following the procedures in Wisconsin Statutes sections
75.35 and 75.69, including sale by land contract, quit claim deed, or warranty
deed with a mortgage from the purchaser, and including a sale for less than the
appraised value if no bid of at least the appraised value is received following the
first attempt to sell the tax- deeded land."
"5. The Finance Committee is authorized to determine the appraised value of the
tax - deeded land or have a certified appraiser determine the value of tax- deeded
land. The Finance Committee is authorized to retain real estate brokers or
salespersons to assist in selling tax - deeded land and to pay fees or commissions
for such service."
