HomeMy WebLinkAboutOrdinance 2004 (657) • ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG -II ORDINANCE NO. (p5") CanvL) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of the PECILUNAS FAMILY TRUST on March 31, 2004, in the St. Croix County Agricultural Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 40 acres of land located in the NE 1/2 of the SE 1/2, Section 15, T28N -R16W, Town of Eau Galle Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The site consists of woods and farm fields. 3. None of the site is identified on the primary environmental corridor map. 4. Almost the whole site has severe limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the site. 5. Applicant has furnished a soil evaluation report documenting a mound type septic system can work with special design criteria. 6. The land around the parcel is zoned exclusive ag to the north and south, ag II to the southwest and ag residential to the northwest and east. 7. The site has access to a town road to the east, 250 Ave. 8. The proposed use of the land is one new building site. 9. Potential development is two 20 -acre lots. 10. The Town Board has no objection to this rezoning and has considered §91.77 in making their decision. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel in the Town of Eau Galle is now rezoned from Agriculture to Ag -II.
