HomeMy WebLinkAboutOrdinance 2004 (654) ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. [ ' C aCo y) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning and Zoning Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning and Zoning Committee held a public hearing on the rezoning request of TODD BJERSTEDT on February 4, 2004, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning and Zoning Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 40 acres of land located in the Town of Troy - SEE ATTACHED Based on the following findings: I . The parcel is in the rural planning area and is an appropriate use. 2. None of the site is environmental corridor. 3. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 4. Surrounding land uses include the City of Hudson to the north and ag residential to the west, south and east. The zoning on the City of Hudson land to the north is industrial. 5. Surrounding zoning is exclusive ag on a small parcel to the north and ag residential to the west, south and east. The zoning on the City of Hudson land to the north is industrial. 6. The site has access to town roads on all sides. 7. Proposed use is residential and institutional development 8. Potential development is approximately 13 to 20 lots. 9. The applicant states that the site was reviewed under the Town of Troy's 60/40 Farm Plan and Transfer of Development Rights Program provisions in the Town's subdivision ordinance. 10. The applicant is proposing 16 lots, 15 residential lots and one institutional lot. Eight lots are allowed under the 40/60 Farm Plan and 8 additional lots from the transfer of Development Rights. 1 1. The Town of Troy has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. 12. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 13. The Ag Residential zoning designation is generally consistent with the Town of Troy Growth Management Plan, dated 2000. Clustered development of one -acre lots is proposed for most of the site with farmette lots and an institutional lot proposed also. A conservation easement prevents additional development on about seven additional acres. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel in the Town of Troy is now rezoned from Agriculture to Ag- Residential.
