After reviewing your file, the zoning department has decided that you will not have to remove one foot or less of your existing deck structure as a condition of your project. Staff has reached this conclusion based on the following findings: 1. You lawfully constructed your home in 1996, in full compliance with ordinance requirements, including a 75 ft. setback from Bass Lake. 2. Bass Lake is notorious for having fluctuating water levels. The OHWL of the lake was modified after your house construction (1998), creating a circumstance where your home was subsequently measured to be 74 ft. or more from the OHWL of the Lake. 3. Staff considers your present home to be in compliance with the shoreland setbacks based on the above facts. 4. This is a unique case and will not be binding on subsequent OHWL determinations or on other administrative decisions. GROUNDWATER SURCHARGE 1983 Wisconsin Act 410 included the creation of surcharges (fees) for a number of regulated practices which can effect groundwater.
