BY -LAWS ARTICLE IV, SECTION C
(RELATING TO THE BOARD OF ADJUSTMENT).

WHEREAS, to make the section more clear, the Administration Committee
recommends that St. Croix County Board of Supervisors Rules and By -Laws Article IV,
Section C — relating to the Board of Adjustment — be amended as follows:
1. A Board of Adjustment is established pursuant to Wisconsin Statutes sec. 59.694.
The Board of Adjustment shall have the powers and duties granted to it by the St.
Croix County Zoning Code to hear and decide:
a. Appeals of administrative decisions relating to zoning.
b. Applications for special exception (conditional use) permits.
c. Applications for variances.
2. The Board of Adjustment shall consist of 5 members — 3 County Board
supervisors and 2 citizens. The Chair of the County Board shall appoint the
members with the approval of the County Board for terms of 3 years beginning on
May 1. The terms shall be staggered so that one or two terms expire every year.
3. Incumbent members shall continue to serve until their term expires.
Notwithstanding the preceding, if a supervisor member is not re- elected to the
County Bo gt(,,'a ne i n he/she is serving on the Board of Adjustment does not
expire that year, a Wady will be deemed to have occurred on the Board of
Adjustment.
4. All members of the Board of Adjustment shall reside within unincorporated areas
of. the..Couxnty.aluino 2 members shall reside in the same town. Members of the
County Planning, Zoning and Parks Committee or the County Land Conservation
coniMine .shall ' t - sue on the Board of Adjustment.
5. The Board of Adjustment shall choose its own chair and vice - chair. The chair
shall conduct the proceedings of the Board of Adjustment pursuant to the County
Zoning Code and its own written rules and by -laws. In the absence of the chair
the vice -chair shall so act.
6. For serving on the Board of Adjustment the members shall receive a per diem and
mileage allowance for each Board of Adjustment session attended in the same
amount and at the same rate as supervisors receive for County Board meetings.
7. Vacancies on the Board of Adjustment shall be filled for the remainder of the
term in the same manner as appointments are made.
8. The Board r of Adjustment shall prepare an annual operating budget in accordance

with County Budget procedures. The County Zoning Department shall provide
staff support to the Board of Adjustment in preparing the budget.
THEREFORE, be it resolved that the St. Croix County Board of Supervisors hereby
rescinds former Article IV, Section C of the St. Croix County Board of Supervisors Rules
and By -Laws and adopts new Article IV, Section C, as set forth above.
