St. Croix County, Wisconsin
WHEREAS, 1999 Wisconsin Act 9 created new comprehensive planning requirements for all local
units of government in Wisconsin; and
WHEREAS, several St. Croix County communities have expressed interest in receiving planning
assistance from the St. Croix County Planning Department; and
WHEREAS, the County Planning Department has added staff resources in 2001 to provide
planning assistance to St. Croix County communities; and
WHEREAS, St. Croix County communities are willing to financially support County Planning
Department staff with State and/or local funding.
THEREFORE, BE IT RESOLVED, that the St. Croix County Board of Supervisors authorizes the
Planning Director to enter into local planning assistance agreements with St. Croix County communities
according to the attached model agreement.

Agreement between the
St. Croix County Planning Department
and the
Town of
This agreement is entered into by and between the St. Croix County Planning Department
(hereinafter referred to as the County) and the Town of , Wisconsin
(hereinafter referred to as the Town).
1. Introduction
A. St. Croix County and the Town of are authorized by Wisconsin
Statutes sec. 66.0301 to contract with other municipalities for the receipt or furnishing
of services.
B. The St. Croix County Planning Department is authorized by St. Croix County Board
Resolution No. to enter into contracts to provide technical planning
assistance to local governments.
C. The Town wants to develop a comprehensive plan under Wisconsin Statutes sec.
66.1001 to provide a guide for making decisions about community growth and
development.
D. The Town has determined that, in order to accomplish this goal in an economical and
effective manner, it is necessary to procure the services of professional planners.
E. In consideration of the mutual covenants and provisions contained herein, the parties
hereby agree to the following:
IL Scope of Services to be Performed by the County
A. In cooperation with the Town Plan Commission, the County staff shall prepare the
Town of Comprehensive Plan for the Town according to the
attached outline /scope of services and in compliance with Wisconsin Statutes sec.
66.1001.
B. County staff will attend Town Plan Commission meetings as necessary.
C. The County will supply the Town with twenty (20) copies of the complete Town of
Comprehensive Plan.

Ill. Town Responsibility
A. The Town shall establish a Town Plan Commission under Wisconsin Statutes § 60.62
(4) to prepare and recommend the Town of Comprehensive Plan
to the Town Board.
B. The Town Plan Commission will meet on a regular basis to fulfill its responsibilities for
preparing the Town of Comprehensive Plan.
C. The Town Plan Commission will review all materials prepared by the County and
provide responses and comments in a timely manner.
IV. Time Schedule
A. The services and responsibilities shall be performed during the period beginning
September 1, 2001 and ending August 31, 2003, unless such period is amended by
written agreement between the parties to this agreement.
B. The County and the Town each have the right to terminate this agreement upon thirty -
(30) day's prior written notice to the other party.
V. Payments for Services
A. The County shall bill the Town for services at the regular hourly rate paid at such time
to County personnel, plus the actual cost of disbursements, including materials, travel
expense and printing. However, under no circumstances will the total cost to the Town
for the aforementioned services and work activities exceed Dollars
($ .00)
B. The County shall periodically bill the Town for work performed, and the Town shall
pay the entire amount of each bill within 30 days of receipt.
C. In the event that the Town terminates this agreement before its completion, the
County will charge the Town only for work done up to the date of receipt of the notice
of termination.
VI. Miscellaneous Provisions
A. It is understood and agreed by both parties that the County employees are performing
this work as independent contractors, and in no event shall the employees be
considered employees of the Town.
B. It is hereby understood and agreed that the County and Town will use the services of
the St. Croix County University Extension Office for designing and implementing
public participation and community involvement programs and activities as part of the
project.
C. The County shall not assign, transfer, or subcontract this agreement without the
written approval of the Town.

D. This agreement may be modified or amended in writing by mutual agreement of the
County and Town.
E. In the event that a dispute arises as to the nature of a right or obligation enumerated
in this agreement or as to the quantity and quality of performance, the parties shall
meet to attempt to resolve the dispute. In the event that the dispute is not resolved by
such meeting, the parties hereby agree to submit the problem or dispute to a joint
meeting of the St. Croix County Planning, Zoning and Parks Committee and the Town
Board. If the dispute is still not resolved, the agreement shall be terminated and the
County shall be paid for all work done up to the time the dispute arose.
F. All communications relating to this agreement shall be made to the County by
contacting David Fodroczi, Planning Director, and all communications shall be made
to the Town by contacting , Plan Commission Chairman.
G. Each person signing this agreement represents and warrants that he or she is duly
authorized and empowered to bind their respective parties.
The County and the Town of hereby execute this agreement.

Subject: Resolution Authorizing Planning Assistance Agreements
Attached is a resolution authorizing the County Planning Department to enter into planning
assistance agreements with St. Croix County communities for your consideration at the September
18 County Board meeting. The resolution includes a model agreement as a referenced attachment.
The resolution and model agreement have been reviewed by Corporation Counsel and
recommended for approval by the Planning, Zoning and Parks Committee.
With the recent enactment of new State comprehensive planning legislation and adoption of the
County Development Plan, we have many towns that are interested in developing town plans with
our assistance. We are working with four towns to start projects this year, and we have at least three
towns that are interested in starting projects next year. These agreements will be used as a vehicle to
clearly delineate responsibilities and reimburse the County for staff time and expenses. We will
also work with communities to obtain State grant funds to support their projects. These local
payments for services are part of our current and future revenue projections.
