HomeMy WebLinkAboutResolutions 2001 (34) RESOLUTION APPROVING AMENDMENT TO TOWN OF HUDSON ZONING ORDINANCE Resolution No. 3 / (a a )) St. Croix County, Wisconsin WHEREAS, at a Public Hearing on October 10, 2001, the Town of Hudson adopted amendments to its zoning ordinance; and WHEREAS, the amendments are shown on the attachment to this Resolution; and WHEREAS, Section 60.62(3), Wisconsin Statutes and Section 7.0 of the Town Ordinance, requires in counties having a county zoning ordinance that no town zoning ordinance amendment of a zoning ordinance is effective unless approved by the county board; and WHEREAS, St. Croix County has a zoning ordinance; and WHEREAS, the Planning, Zoning and Parks Committee has reviewed the proposed amendments and recommends approval. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the amendments to the Town of Hudson Zoning Ordinance set out in the attachment are hereby approved. Nelson, St. Crobc County Cierk Motion by Supervisor Ostby, 2 by Supervisor Foster, to approve the changes to 105-9 B (4) as recommended at the Public Hearing. 105-9 B (4) is deleted as a permitted use and becomes a use thatInay be allowed as a special exception. It will be numbered as 105-9 G (6) and will read as follows: " Agricultural warehouses, agricultural shops and agricultural storage yards, provided that any such use shall be located not less than 100 feet from the nearest boundary of any lot used for the same purpose." Motion carried. Motion by Supervisor Foster, 2 by Supervisor Ostby to approve the recommendation to add the following sentences to 105-12 B Commercial District — Permitted Uses: " The following are uses permitted in the Commercial District. Any use not listed as a permitted use shall be deemed to be a prohibited use." Motion carried. Motion by Supervisor Ostby, 2" by Supervisor Foster, to approve the recommended amendment to 105-12 B (16) Commercial District, Gasoline Stations deleting the current definition and replacing it with "Gasoline Stations primarily used by residents and the traveling public operating automobiles as defined in Section 340.01 (4) Wisconsin Statutes." Motion carried. Motion by Supervisor Foster, 2 by Supervisor Ostby, to approve the recommended amendment to 105-26 Sign Ordinance — Notice of Violations; Assessment of Costs as worded in the Public Hearing. Motion carried. Motion by Supervisor Ostby, 2' by Supervisor Foster, to approve the recommendation to add 105-10 G 3 (p), Wind Energy Systems, to the Special Exception portion of the Agricultural/Residential portion of the Zoning Ordinance with the following conditions induded; 1. Towers must be set back a distance equal to 1.1 times their overall height from any property line and three times their overall height from any existing adjoining residence. 2. Parcels Must be larger than 5 acres and only one tower per parcel is permitted. 3. Maximum overall permitted height is 100 feet induding the height of blade and tower. 4. Blades must be a minimum of 30 feet above the ground level at the tower base. 5. Towers must not be climbable within 15 feet of the ground. 6. Noise level shall be no higher than 8 decibels over background noise measurements at any property line. Measurements of both are to be taken at the same time and under the same conditions. 7. The applicant shall take reasonable steps to eliminate and/or mitigate any interference with radio or television signals caused by any Wind Energy System. 8. Any Wind Energy System not producing energy for a 12 -month consecutive period must be removed. 9. $100 fee is to be paid to the Town to cover costs of inspections performed by the Building Inspector. Motion carried. Motion by Supervisor Foster, 2 by Supervisor Ostby, to close the Special Town Board Meeting. Special Exception Hearing per the request of Steven and Sandra Peterson of 767 Holden Lane to locate a Wind Energy System on their property was called to order by Chairman Johnson immediately following the Special Town Board Meeting October 10, 2001. Motion by Supervisor Ostby, 2" by Supervisor Foster, to approve the Special Exception request for a Wind Energy System for Steven and Sandra Peterson at 767 Holden Lane as described in exhibits A, B, C, and D dated 10 /10 /01, subject to the conditions of 105-10 G 3 (p) and contingent upon approval of 105-10 G 3 (p) being approved by the County. Two copies of plans shall be provided to the Building Inspector so inspections can be identified and scheduled. $100 shall be paid to the Town to cover costs of inspection. Motion carried. Motion by Supervisor Ostby, 2 by Supervisor Foster, to adjourn the Special Exception Hearing. Motion carried. Following the Special Exception Hearing a working session on the 2002 budget was held.
