HomeMy WebLinkAboutResolutions 2000 (14) RESOLUTION APPROVING EASEMENTS FOR THE INSTALLATION OF UTILITIES AT HOMESTEAD PARKLANDS ON PERCH LAKE Resolution No. /( 44- b) St. Croix County, Wisconsin WHEREAS, the visitor center at Homestead Parklands on Perch Lake (the Park) will need electric, telephone, and natural gas service (utilities) when constructed; and WHEREAS, the access road to the Park is under construction and the utilities can be placed next to the road; and WHEREAS, the utility lines will remain the property of the companies up to the visitor center and the companies need easements to enter upon County property to inspect and maintain the lines after installation; and WHEREAS, the Planning, Zoning and Parks Committee and the Finance Committee have reviewed this matter and recommend approval of the easements. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the attached easement be granted to each of the following for inspection and maintenance of their utility lines at Homestead Parklands on Perch Lake: Ameritech — telephone service Midwest Natural Gas — natural gas service St. Croix Electric Cooperative — electric service. FURTHER, be it resolved that the Board Chair and County Clerk are authorized to sign the easement agreements on behalf of St. Croix County. Offered by the Finance Committee on May 16, 2000. The Grantee is granted an easement to construct, operate and maintain its distribution line under the above - described lands; to inspect and make such repairs as Grantee may from time to time deem advisable; to cut, trim and control the growth by spot application of herbicides, machinery or otherwise of trees and shrubbery located within 10 feet of the center line of said line, or that may interfere with or threaten to endanger the operation and maintenance of said line (including any control of the growth of other vegetation in the right -of -way which may incidentally and necessarily result from the means of control employed); to keep the easement clear of all buildings, structures or other obstructions; to obtain access, ingress, and egress over and across the property of Grantor for purposes of exercising the rights granted hereby; and to apportion or assign to third parties all or any portion of the rights herein granted. The Utility shall restore the surface disturbed by any construction or maintenance of its distribution line to its condition before the disturbance. The installation shall meet the Uniform Utility Accommodations Policy. This is a non - exclusive easement. The Grantor agrees that all facilities placed on the property by Grantee pursuant to this easement shall remain the property of the Grantee. The undersigned covenant that they are the owners of the above - described lands and that the said lands are free and clear of encumbrances and liens of whatsoever character except those held by the following persons: Donna Mae D. Seim, land contract vendor, who join herein for the purpose of authorizing this easement. This conveyance shall be binding on the heirs, representatives, assigns and grantees of the Grantor.
