HomeMy WebLinkAboutResolutions 2000 (19) . � RESOLUTION ADOPTING POSITION THAT THE AGREEMENT FOR GOVERNMENT SERVICES IS NULL AND VOID Resolution No. l t b) St. Croix County, Wisconsin WHEREAS, the St. Croix County Board of Supervisors entered into the Agreement for Government Services with the City of Hudson, the Lac Courte Oreilles Band of Lake Superior Chippewa Indians, the Red Cliff Band of Lake Superior Chippewa Indians, and the Sokaogon Chippewa Community Mole Lake Band of Lake Superior Chippewa Indians; and WHEREAS, the Agreement provides that the City of Hudson and St. Croix County will provide government services to a casino proposed by the Tribes to be located in the City should the casino come into existence; and WHEREAS, the Agreement contains a provision which states that in the event that a determination is made by the Secretary of the Interior not to take land into trust or to approve the Agreement, the Agreement shall be null and void and have no further force or effect; and WHEREAS, on July 14, 1995 the Secretary rejected the application to take land into trust; and WHEREAS, the Agreement contains provisions that land would be taken into trust not later than 1995; and WHEREAS, land was not taken into trust before or during 1995; and WHEREAS, based on the Secretary of the Interior's denial of the application to take land into trust and/or the fact that land was not taken into trust by the end of 1995, it is the opinion of the St. Croix County Corporation Counsel that the Agreement is null and void, unenforceable, and has no binding legal effect on the County. THEREFORE, be it resolved that the St. Croix County Board of Supervisors adopts the Corporation Counsel's opinion that the Agreement for Government Services is null and void, is unenforceable, and has no binding legal effect on St. Croix County; FURTHER, be it resolved that a certified copy of this resolution be provided to all other parties to the Agreement, the Hudson School District Administrator, the Secretary of the Interior and the Bureau of Indian Affairs, Wisconsin Governor Tommy Thompson, and area legislators.
