The field notes show that the lake did not extend down into the Fractional SW1/4 of the SW1/4. Therefore the plat shows this quarter-quarter section as containing 41.20 acres. Wisconsin common law states that lakes are held in the Public Trust end case law has determined that the "boundary" of a lake is the Ordinary High Water Mark (OHWM). Therefore, since much of the SWi/4 of the SW1/4 lies below the OHWM, title to this property would lie with the state. However, any land lying above the OHWM would be titled to the current deed holder, including, in this case, the island that has been formed. It is the Intent of this Certified Surrey Map to include the island with Lot 1 and make it a part thereof.
