HomeMy WebLinkAboutResolution 1999 (30) RESOLUTION FOR SHORT TERM DETENTION OF JUVENILES IN NEED OF PROTECTION OR SERVICES RESOLUTION D <l�) WHEREAS, Chapter 938.355(6d) of the Juvenile Justice Code allows the use of short term detention for placement in a secure detention facility or in a place of non - secure custody for up to 72 hours; and short term detention can be utilized if the juvenile has been adjudicated as a Juvenile in Need of Protection and Services (J1PS). WHEREAS, the juvenile's caseworker or any other person authorized to provide intake or dispositional services for the Court may, without a hearing, take the juvenile into custody and place for up to the 72 hours as an immediate intervention; and the juvenile must be informed and understand that 72 hour placement may occur while alleged violations and appropriateness of a sanction are being investigated or for a violation of supervision conditions; and WHEREAS, Chapter 938.355(6m)(a)lg allows for sanctions for violations if order for truancy and habitual truancy. Placement of the juvenile in a secure detention facility or in a place of non - secure custody for not more than 10 days. WHEREAS, the legislative change requires that this dispositional alternative be approved and authorized by the County Board of Supervisors. NOW, THEREFORE BE IT RESOLVED, that the St. Croix County Board of Supervisors authorizes the use of short term detention (72 hours hold) and the sanction for violation of order for truancy or habitual truancy for youth that are adjudicated as Juveniles in Need of Protection or Services (JIPS). The utilization of short term detention and this sanction shall be limited to the established procedures of the Department and by order of the Court. Dated this 14 day of September, 1999.
