PENALTIES FOR USE OF A FIREARM IN THE COMMISSION OF A CRIME
Resolution No. 3.2.
St. Croix County, Wisconsin
WHEREAS, crimes committed with firearms have a particularly strong potential to cause
devastating harm and loss of life; and
WHEREAS, the states of California and Florida have enacted laws (commonly referred to
as the 10 /20/Life law) which provide mandatory additional penalties for persons who use a
firearm in the commission of a felony or a violent crime; and
WHEREAS, the California law provides that a person convicted of a specified felony who
was charged as a principal in the commission of the offense and personally used a firearm during
the commission of the offense shall be punished by an additional term of 10 years in the state
prison, to be imposed consecutive to the punishment prescribed for the felony; if the firearm is
intentionally discharged under those circumstances, the person would be punished by an additional
term of 20 years in the state prison, to be imposed consecutive to the punishment prescribed for
the felony; if great bodily injury was caused to any person other than an accomplice as a result of
the firearm being discharged under those circumstances, the person would be punished by an
additional term of 2 5 years to life in the state prison, to be imposed consecutive to the punishment

WHEREAS, it is recommended that the state of Wisconsin enact similar legislation.
THEREFORE, be it resolved by the St. Croix County Board of Supervisors that it urges
the Wisconsin legislature and Governor Thompson to seriously consider establishing a law
substantially similar to the state of California's 10 /20/Life law;
FURTHER, be it resolved that a copy of this resolution and the attached copy of
California Assembly Bill No. 4 be delivered to our area legislators and Governor Thompson by
the County Clerk;
FURTHER, be it resolved that the County Clerk ask one or more of our area legislators if
he /she can deliver copies of this resolution to all other state legislators.
