ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE M- RESIDENT1AL
ORDINANCE NO. F Il 0 -06
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning,
Zoning and Parks Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public
hearing on the rezoning request of ROBERT AND SHIRLEY ORF on December 10, 2003, in the
St. Croix Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having
considered all written information and verbal testimony presented at the hearing, and finding that
the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the
following described land:
110 +1- acres of land located in the South 1/2 of the NW 1/4 and the NW 1/4 of the SW 1/4,
Section 3, T29N -R19W, Town of S. Joseph, St. Croix County, Wisconsin, EXCEPT for
parcels described in deeds recorded in Vol. 389, page 593, Doc. #270640; Vol. 456, page
485, Doc. #298512; Vol. 457, page 470, Doc. #298935; and Vol. 464, page 33, Doc.
#301666 in the office of the Register of Deeds for St. Croix County, Wisconsin. See
attached deeds for legal descriptions for exceptions.
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. All but eight acres of the site is planted to trees in the Managed Forest Law program
according to the applicant.
3. A very small portion of the site is prime farmland.
4. The whole site is part of an environmental corridor.
5. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS).
6. Surrounding land uses include open recreation land to the south, east and west and a
subdivision to the north.
7. Surrounding zoning on the north portion of the site is ag residential to the west, north and on
two small sites to the east. Surrounding zoning on the south portion of the site is
conservancy to the west, south and east.
8. A town road running east and west between the north and south portions splits the site.
9. Potential development is about 35 three -acre lots.
10. The soils on the site are Class III under the Soil Classification System of the Natural
Resource Conservation Service. It should be noted that they are highly erosive due to
slopes.
11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
12. The Town of St. Joseph has recommended approval of the request and has considered
§91.77 in making their decision.
13. The ag residential zoning designation for 110 acres is consistent with the Town of St.
Joseph Comprehensive Plan, dated 1995, amended 2003.
14. The Town motion states that the rezoning does not have an impact on woodlands or
environmental features because no change in use or development is proposed at this time.
The Town further states that the property is suitable for potential development in the
future and potential development would not cause negative impacts to environmental
features or areas. The motion further states that any impacts to environmental areas
would be addressed through the town subdivision ordinance.
15. The Town also states that they have, or intend to provide, adequate public facilities to
accommodate any potential development of the property.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 110 -acre parcel in the Town of St. Joseph is now rezoned from
Agriculture to Ag- Residential.
