CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.- RESIDENTIAL REZONING LAND FROM AGRICULTURE TO AG -II ORDINANCE NO. & a C.-x6031 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of GERRY VEENENDALL on February 26, 2003 in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED (2 parcels; 5 -Acres Ag to Ag /Res and 20 -Acres Ag to Ag -II) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open land used for farm fields with an existing residence and some woods around the residence. 3. Site is part of a larger farm of 80 acres. 4. Site is located approximately 1 mile from the Baldwin Village limits. 5. There are probably sand and gravel deposits located under about half the site. 6. There are no environmental corridors on the site. 7. Environmental features include a stream and small area of 12 to 20 percent slope. 8. The majority of the parcel proposed to be Ag II and the parcel to remain in exclusive ag have moderate to severe limitations for Private Onsite Wastewater Treatment Systems (POWTS). 9. Surrounding land uses include one small lot to the northwest, a 10 -acre site to the northeast and open agricultural land around the site everywhere else. 10. Surrounding zoning is exclusive ag to the west and south and ag residential to the north and east. 11. The site has access to a town road to the north. 12.A perk test has been done and onsite treatment is possible. 13. Proposed use is one or two new building sites, one on the proposed 20 -acre Ag II parcel and one on the 55 -acre parcel remaining in exclusive ag. 14. Potential development is three new building sites, the two proposed and one additional lot on the 5 -acres proposed for ag residential zoning. 15.A site layout and access for the parcels is provided. 16. There is no Town Plan, however, the town is in the process of developing a plan. 17. The soils on the site are Class I I or better under the Soil Classification System of the Natural Resource Conservation Service. 18.The Land Evaluation Site Assessment Score is 136. 19. The St. Croix County Natural Resource Management Plan Goals II,, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 20.The Town of Baldwin has reviewed the rezoning application and recommended approval stipulating that the request is consistent with § 91.77. With the following condition: 1. The new 5 ( +1 -) acre lot shall not be further subdivided in the future, unless approved by the St. Croix County Board of Supervisors. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 5 -acre parcel is now rezoned from Agriculture to Ag.- Residential and the 20 -acre parcel be rezoned from Agriculture to Ag -II.
