CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.-RESIDENTIAL ORDINANCE NO. 6 a Li ( a ba 3,) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of Douglas H. Rivard on November 13, 2002, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land being the NW 1 /4 of the NE 1/4 and the SW 1 /4 of the NE 1 /4 of Section 4, T31N, R18W, Town of Star Prairie, St. Croix County, Wisconsin, further described as follows: Beginning at the N 1 /4 Corner of said Section 4; thence N 88 °01'25 "E along the North line of the NE 1 /4 1319.51' to the East line of the W 1 /2 of the NE 1/4 of said Section 4 (Bearings referenced to the North line of the NE 1 /4 of Section 4, assumed to bear N88 °01'25 "E); thence S00 °13'33 "E 2986.13' along said East line of the W 1/2 of the NE 1 /4 to the East — West 1/4 Section line of said Section 4; thence S89 °29'26 "W 1307.00' along said East — West 1 /4 Section line to the North- South 1 /4 Section line of said Section 4; thence N00 °27'25 "W 2952.31' along said North - South 1 /4 Section line to the N 1 /4 Corner of said Section 4 being the point of beginning, containing 3,898,533 square feet (89.498 acres) more or less. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site is a portion of a larger 261 -acre farm. The site is in the east 1/3 of the larger site. 3. Portions of the site are actively farmed with tilled fields and pastureland and some wooded areas. 4. The whole site is within a primary environmental corridor. 5. Environmental corridor features include two wetlands, one large and one small; four closed depression; 12 to 20 percent slopes and shorelands. 6. A small portion of the site has very poor soils with severe limitations for Private Onsite Wastewater Treatment Systems (POWTS). 7. No portion of the site is prime farmland. 8. Surrounding land uses include a mixture of large open prime farmland to the west, poor farmland and woods to the south, and a large subdivision_(Mallard Run) to the east. To the north is Polk County and a large expanse of prime farmland. 9. Surrounding zoning is exclusive ag to the west; ag residential to the south and east; and to the north is Polk County. 10. Site is located on a town road to the north. An additional connection is available through a stubbed town road to the east in the existing subdivision. 11. Immediately to the west of the proposed rezoning are the farmstead and a wooded area running north and south. This wooded area provides a natural buffer to the prime farmland on the remaining 174 acres of this farm. 12. Proposed development is 12 parcels based on the plan submitted by the applicant. 13. The large wetland is located near the town road on the north side of the site. A secondary pond is located slightly to the south. Any access around these critical areas must address protection both during and after construction. 14. The owners should be encouraged to preserve environmental features and to be aware of the limitations associated with these features, i.e. 20 percent or greater slopes are to be avoided for land disturbance. The environmental elements should be incorporated into any type of development. 15. During design, POWTS should be located so that there is not a conflict with the wetlands, closed depressions and the limiting soils for POWTS. 16. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 17. Town of Star Prairie has recommended approval of the rezoning and considered Statute 91.77 with their decision; the County also considered Statute 91.77 with their decision. Approval of this rezoning shall incorporate the above findings and will be contingent upon the following conditions: 1. Approvals under the County subdivision ordinance and sanitary code shall incorporate these findings listed above. 2. Because the entire property is located within a primary environmental corridor and because there is a large area of prime farmland to the north and west, the 87 acres shall not be subdivided into more than 12 parcels. This condition shall be shown on the plat and shall be placed on every deed conveying any lot on this parcel. The County must review and approve any land divisions or exchanges of land between adjacent owners. County approvals and required deed restrictions shall be recorded at owners' expense. 3. Because the entire property is located within a primary environmental corridor, development shall not be allowed on slopes 20% or greater or in closed depressions. Design elements for this development must: Protect wetlands and slopes less than 20% by using best management practices; incorporate erosion and sediment control and storm water management; and protect and preserve interior woodland habitat by building on fringes of woodland areas. 4. The County Board ordinance, which incorporates the legal description of the land rezoned along with the findings and conditions, shall be recorded at owners' expense. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 89.498 +1- acre parcel is now rezoned from Agriculture to Ag: Residential.
