ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL
ORDINANCE NO. (, g 5 C
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning,
Zoning and Parks Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public
hearing on the rezoning request of GLORIA BASEL on December 10, 2003, in the St. Croix
Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having
considered all written information and verbal testimony presented at the hearing, and finding that
the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the
following described land:
80 acres located in the E 1/2 of the NW 1 /4, Section 19 T3ON -R19W, EXCEPT Lot 1 of
Certified Survey Map in Vol. "9 ", page 2429, Doc. No. 476656 and 34 acres located in the
NW 1/4 of the NW 1/4 of Section 19, T3ON -R19W, EXCEPT Lot 1 of Certified Survey Map
in Vol. "6 ", page 1588, Doc. No. 405770. Parcel to be rezoned is 114 -acres more or less.
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. The whole site is within a primary environmental corridor.
3. Environmental corridor features include wetlands /closed depressions.
4. Surrounding zoning is exclusive ag to the east and ag residential to the north, south and west.
5. The site is located on County Road V, running north and south through the property and
abuts town roads to the north and south.
6. Potential development is approximately 38 three -acre home sties.
7. As the owners consider design elements they should be encouraged to: protect the closed
depressions and wetlands; use best management practices, erosion and sediment control
and stormwater management for the steep slopes; and protect the interior woodland
habitat.
8. During design, POWTS should be located so that there is not a conflict with the wetlands,
closed depressions and the limiting soils for POWTS.
9. The St. Croix County Natural Resource Management Plan Goals II, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
10. The ag/residential zoning designation for 114 acres is consistent with the Town of St.
Joseph Comprehensive Plan, dated 1995, and amended 2003.
11. The Town motion states that the rezoning conforms to §91.77 as the Town has adequate
public facilities to accommodate any potential development.
12. Town indicated that future implementation of impact fees will generate revenue to offset
costs related to public services and facilities needed in the future.
13. Town also indicated that any impacts to environmental areas would be addressed through
subdivision Chapter 168 and Comprehensive Plan, both of which promote efficient and
desirable use of land.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 114 -acre parcel in the Town of St. Joseph is now rezoned from
Agriculture to Ag- Residential.
