HomeMy WebLinkAboutOrdinance 2003 (644) . / ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG-RESIDENTIAL ORDINANCE NO. Le/ (003) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of SANDRA KLUEDTKE on November 19, 2003, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: 40 acres of land located in the SE 1/4 of the SW' /4,Section 17, T3ON- R19W,Town of Somerset. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open land used for farm fields with some woods. There are scattered closed depressions and moderate slopes on the site. 3. None of the site is prime farmland. 4. The whole site is environmental corridor. 5. The environmental features include a closed depression, shorelands, steep slopes and intermittent stream and some woodland. 6. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS). 7. Surrounding zoning is exclusive ag to the west and ag residential to the north, south and east. 8. The site has access to a town road, 42 Street, to the west. This access is limited and an extensive internal road system would be needed if the site developed. The site access needs to be confirmed prior to rezoning. 9. Proposed use is one new building site and sale of approximately 10 acres to an adjoining landowner. The specific building location has not been indicated. 10. Potential development is approximately 13 lots. 11. The County Highway Department has verified that there is suitable access to the site. 12. The St. Croix County Natural Resource Management Plan Goals II, HI and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 13. The Town of Somerset has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan. 14. The area is in proximity to some existing development. The parcel's terrain is suitable for development. ./ THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
