CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG.-RESIDENTIAL ORDINANCE NO. &-/ 3 c 2.0 d 3) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of WALTER GERMAIN on November 19, 2003, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: See attached description (44 +/- acres from Ag to Ag/Residential) Based on the following findings: 1. There are two separate parcels in this rezoning; the northern site is approximately 24 acres and the southern site is approximately 20 acres. 2. Both parcels are in the rural planning area and are an appropriate use. 3. The northern site is part of a larger site of 226 acres. The southern site is a separate site. 4. Each site consists of an existing home with outbuildings on open rolling land with some woods. Neither site is currently used for farming. 5. The northern site has two closed depressions, shorelands, wetlands and moderate slopes. 6. The southern site has a very large wetland and closed depression, a second closed depression, woods, moderate slopes and shorelands. 7. The northern site is approximately a third prime farmland, the southern site has a very small area of prime farmland. 8. Both sites are completely within environmental corridor. 9. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the northern site and only a very small area of limitation on the southern site. 10. Surrounding zoning is exclusive ag to the east and ag residential to the north, south and east. 11. The northern site has access to State Trunk Highway 35 to the east. The southern site hs access to State Trunk Highway 35 from a shared driveway. These accesses are limited and an extensive internal road system would be needed if the site developed. 12. Proposed use is to sell the northern building sites with approximately 5.5 acres and combine the remaining acres with the adjoining property. 13. No changes are proposed at this time on the southern site. The rezoning is requested because the lot size is not 35 acres as required by the exclusive ag district. 14. Potential development is approximately 13 lots. 15. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 16. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan. 17. The area is in proximity to some existing development. The parcel's terrain is suitable for development. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 44 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
