Statute 91.77, voted to approve a rezoning of the following described land: 40 acres of land located in the NW 1/4 of the NW ' /a,Section 10, T31N- R19W,Town of Somerset. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. Site consists of open rolling land with two large closed depressions and some woods. 3. The site has a large closed depression with water, a second smaller closed depression, moderate to severe slopes and shorelands. 4. There are no prime farmlands on this site. 5. The whole site is an environmental corridor. 6. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS) on the site. 7. Surrounding land uses include open agricultural land to the east, west and north and smaller residential sites to the south. 8. Surrounding zoning is exclusive ag to the north, west and south and ag residential to the east. 9. The site has access to a town road, 50` Street, to the west. 10. Proposed use is to develop residential lots of between three and five acres each. 11. Potential development is approximately 12 lots. 12. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 13. The Town of Somerset has recommended approval of the rezoning, and has considered §91.77 in making their recommendation. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning is generally consistent with the Town Plan. 14. The area is in proximity to some existing development. The parcel's terrain is suitable for development. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel in the Town of Somerset is now rezoned from Agriculture to Ag- Residential.
