CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL ORDINANCE NO. 60 G.160 4) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of DONALD E. AND ALICE M. ZIEGLER on October 22, 2003, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED (4.775 +/ acres — Ag to Ag/Residential) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. A very small portion of the site is good farmland. 3. There are probable sand deposits located under the whole site. 4. Surrounding land uses include two small lots to the west, open agricultural land to the north, east and south and the wildlife areas. 5. Surrounding zoning is exclusive ag to the east, north and south and ag residential to the west. 6. The site has access to a town road to the south. 7. Proposed use is two residential lots approximately 2.5 acres each. 8. Potential development is two home sites. 9. Site layout, with a roadway easement for one of the lots, is provided. 10. The soils on the site are approximately 50 percent Class III (eroded) and 50 percent Class IV, with a very small amount of Class II, base on the Soil Classification System of the Natural Resource Conservation Service Soil Survey for St. Croix County. 11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 12. There is no Town Plan, however, the town is in the process of developing a plan. 13. The Town of Stanton recommends approval of the request and has considered §91.77 in making their decision. The Town Board states that it meets their rezoning criteria because it does not have a history of economically viable farming activities, a very small portion of the lots have woodlands, the soil is predominately Class IV, and a public road is not required. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 4.775 acre parcel in the Town of Stanton is now rezoned from Agriculture to Ag- Residential.
