ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG- RESIDENTIAL

WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning,
Zoning and Parks Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public
hearing on the rezoning request of NORMAN AND SHIRLEE FEYEREISEN on October 22,
2003, in the St. Croix County Government Center in Hudson, Wisconsin; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having
considered all written information and verbal testimony presented at the hearing, and finding that
the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the
following described land:
SEE ATTACHED (82.53 +/- acres — Ag to Ag/Residential)
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Site consists of open cropland and some pastureland. There is an intermittent stream on
the site
3. None of the site is environmental corridor.
4. None of the site has limitations for Private Onsite Wastewater Treatment Systems
(POWTS).
5. Surrounding land uses include agriculture to the south, and residential development to the
north, west and east.
6. Surrounding zoning is exclusive ag to the south and ag residential to the north, east and
west.
7. Access to the site is off of Townsvalley Road to the west and CTH FF to the north.
8. Proposed use is 37 lots under the Town of Troy Subdivision Ordinance — 18 lots under
the 60 /40farm plan and 19 lots from the Transfer of Development Rights.
9. The applicant is attempting to cluster the development on the least desirable farmland.
10. The applicant states that site was reviewed under the Town of Troy's 60/40 Farm Plan
provisions in the subdivision ordinance.
11. Town of Troy has reviewed the rezoning and recommends approval, stating that they
have considered §91.77 in making their decision.
12. The St. Croix County Natural Resource Management Plan Goals II, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational
and scenic values and wildlife habitat.
13. The Ag Residential zoning designation for 82.53 acres is generally consistent with the
Town of Troy Growth Management Plan, dated 2000. The parcel is mostly prime
farmland. Cluster development is proposed for the less productive portions of the site,
and the remaining agricultural lands are protected through conservation easement and
transfer of development rights, which limit development to 6 -acre lots.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the 82.53 acre parcel in the Town of Troy is now rezoned from Agriculture
to Ag- Residential.
