CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG-II ORDINANCE NO. 033 (.X) • WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of JOHN AND JOAN NEUMANN on August 13, 2003 in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED (64 + /- -Acres from Ag to Ag -II) Based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. The site is open flan land used for crops with an intermittent stream in one corner. 3. Approximately 3 /< of the site is identified on the potentially productive agriculture map as very good farmland. 4. None of the site is identified on the primary environmental corridor map. 5. Approximately 1/3 of the site has slight to severe limitations fro Private Onsite Wastewater Treatment (POWTS). 6. There are no probable sand or gravel deposits on the site. 7. The surrounding land uses include large acreage farms to the west and south, 20 to 40 acre hobby farms to the north and two small acreages to the east. 8. The land around the parcel is zoned exclusive ag to the south, north, west and northeast and ag/residential to the east. 9. The site is located on a town road. 10. The proposed use of the land is one new building site. 11. Potential development is one lot. 12. The Land Evaluation Site Assessment Score is 145. 13. The Town Board has recommended this rezoning. 14. Staff recommended the following for committee consideration: Rezone to Ag ]I. With the following condition: 1. These 64 acres are not to be further subdivided for a residential building site. The County Board rezoning ordinance, which incorporates the legal description of the land rezoned along with the findings and conditions, shall be recorded at the owner's expense. 2. Any building on the property that contains livestock shall be located 100 -feet from any neighboring residential property line. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the X �64 -acre parcel is now rezoned from Agriculture to Ag -II.
