CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG-H ORDINANCE NO. to 3 7 (2009 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of WILLIAM LIDDLE on June 18, 2003, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A 40 -acre parcel located in the NE 1 /4 of the SE 1/4, Section 32, T28N -R17W, Town of Pleasant Valley, St. Croix County, Wisconsin. Based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. The site consists of footings from abandoned buildings, waterways and pasturelands. 3. Approximately 1/3 of the site is identified on the potentially productive agriculture map as very good farmland. 4. None of the site is identified on the primary environmental corridor map. 5. The majority of the site has slight to severe limitations for Private Onsite Wastewater Treatment (POWTS). 6. Applicant has furnished a soil evaluation report documenting a mound system can work in the southwest portion of the site. 7. There are no probable sand or gravel deposits on the site. 8. The surrounding land uses include agriculture to the west, south and east and a 20 -acre parcel to the north. 9. The land around the parcel is zoned exclusive ag to the north, south, west and east and commercial to the northeast. 10. The site is located on a county road to the north and a town road to the east. 11. A conceptual site layout showing access is provided. 12. The proposed use of the land is one new building site with outbuildings for animals. 13. At the request of staff the applicant contracted for the preparation of a Wetland Delineation Report. The modified site plan, now indicates that there is a building site present on the property suitable fore development. 14. The applicant states that they wish to place a limitation or condition on the rezoning that prevents further subdivision of the parcel maintaining a one dwelling unit per 40 acre (1/40) density on the parcel. 15. The Land Evaluation Site Assessment Score is 116. 16. The Town Board has reviewed the request and recommended approval stipulating that the request is consistent with § 91.77 and with the condition that the 40 -acre site be limited to one building site. With the following conditions: 1. Applicant shall apply for a special exception permit for the crossing of the intermittent stream on the property. The navigable stream is a tributary of the Rush River. This public hearing permit requires review and approval from the County and the DNR. 2. These 40 acres are not to be further subdivided for a residential building site. The County Board rezoning ordinance, which incorporates the legal description of the land rezoned along with the findings and conditions, shall be recorded at the owner's expense. 3. Any building on the property that contains livestock shall be located 100 -feet from any neighboring residential property line. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel in the Town of Pleasant Valley is now rezoned from Agriculture to Ag -ll.
