ORDINANCE AMENDING CHAPTER 17
ST. CROIX COUNTY LAND USE ORDINANCE
REZONING LAND FROM AGRICULTURE TO AG.-RESIDENTIAL
ORDINANCE NO. 6'3
WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development
Committee to act in all matters pertaining to county planning and zoning; and
WHEREAS, the St. Croix County Board has established the St. Croix County Planning,
Zoning and Parks Committee; and
WHEREAS, at the request of the County Board this Committee is to review petitions, hold
public hearings, and present its recommendations for rezoning requests to the County Board for
action; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public
hearing on the rezoning request of PAT MCNAMARA on February 26, 2003, in the St. Croix
County Agricultural Center in Baldwin, Wisconsin; and
WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having
considered all written information and verbal testimony presented at the hearing, and finding that
the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the
following described land:
SEE ATTACHED ( 0.97 acres — Ag to Ag/Residential )
Based on the following findings:
1. The parcel is in the rural planning area and is an appropriate use.
2. Site consists of an existing building site to the north with adjacent farmland to the south and east.
3. The site is part of a larger farm of 69 acres.
4. The site is not identified on the primary environmental corridor map.
5. There are no environmental features.
6. There are no limitations for Private Onsite Wastewater Treatment Systems (POWTS).
7. Surrounding land uses include a farmstead to the north and farmland to the south, east and west.
8. Surrounding zoning is exclusive agriculture to the east, south and west and ag /residential to the
north.
9. The site has access to a County road to the west.
10. There is no Town Plan, however, the town is in the process of developing a plan.
11. The St. Croix County Natural Resource Management Plan Goals II, III and IV also
encourages protection and preservation of surface waters and wetlands; fish and wildlife
habitats; and agricultural land and soils to preserve ecological functions and recreational and
scenic values and wildlife habitat.
12. The Town of Erin Prairie has provided a recommendation to approve the rezoning request and
has considered §91.77 in making their decision.
13. Staff recommend the following for committee consideration: Rezone only a 0.97 -acre parcel to
square off the existing building site of 1.68 acres. This will bring the acreage of the building site
to over 2 acres, which is consistent with the County's required minimum lot size.
THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting
in regular session, that the .97 -acre parcel in the Town of Erin Prairie is now rezoned from
Agriculture to Ag.- Residential.

Erin Prairie, St. Croix County, Wisconsin; described as follows:
Commencing at the W1/4 corner of said Section 8; thence N01 °37'32 "E, along the west line of
the NW1 /4 of said section, 859.00 feet to the point of beginning; thence continuing
N01 °37'32 "E, along said west line, 6.01 feet to the south tine of Lot 1 of Certified Survey Map
recorded in Volume 16, Page 4429 at the St. Croix County Register of Deeds office; thence
N88 ° 06'04 "E, along said south line, 434.87 feet to the southeast corner of said Lot 1; thence
S00 °20'58 "W 185.07 feet; thence S89 °01'14 "W 398.91 feet to the east line of County Trunk
Highway GG; thence N00 °20'58 "E, along said east line, 54.43; thence S88 °22'28 "E 261.54 feet;
thence N01° 37'32"E 116.00 feet; thence N88° 22'28"W 300.00 feet to the point of beginning.
Parcel contains 0.97 acres (42,293 sq. ft.) and is subject to County Trunk Highway GG right -of-
way and all other easements, restrictions and covenants of record.
