COMMUNITY DEVELOPMENT COMMITTEE
MARCH 22, 2012
CALL TO ORDER: Chair Steve Hermsen called the meeting to order at 4:05 p.m.
ROLL CALL - Members Present: Supervisors Steve Hermsen, Sharon Norton- Bauman, Bill
Peavey, Richard `Buzz' Marzolf and Lorin Sather. Robert Shearer and FSA Representative
Edward Sontag were absent and excused.
STAFF PRESENT: Pat Thompson, Don Gillen, Pete Kling, Kevin Grabau and Monica Lucht.
GUESTS: Jon Sonnentag, Ed Hendricks, Ken Roberts and Dave Ostness.
APPROVAL OF MINUTES OF PREVIOUS MEETING: Motion by Sather, 2nd by Peavey
approving the minutes of March 1 and 15, 2012. Motion carried.
BUSINESS ITEMS
Review Fee from Hendricks Rezoning Denial: Chair Hermsen explained this item, which was
not properly discussed at the previous committee meeting, and is now on the agenda for
discussion. It concerns the FSA Representative, Edward Sontag, and if he was allowed to vote on
the refunding of a review fee. Kling stated that Sontag cannot vote on the rezoning files, but does
have a vote on anything related to the fee schedule, because of the animal and livestock fees listed.
Sontag only voted on the motion for refunding the review fee, and because of his vote, the motion
for a refund failed.
Review Fee Schedule for all Planning & Zoning Charges: The committee discussed the `non-
refundable' wording on the Land Use Ordinance Fee Schedule and what the difference was between
`required' and `additional' fees. The fee schedule should clarify what is required and what is
additional. The discussion continued regarding the county's reason for collecting application fees
upfront, what the circumstances are for allowing withdrawals of applications, and what happens when
applications are denied. Staff explained that from the start, applicants are informed of the process and
are given opportunity to make decisions regarding their application as further review comes in, and
staff is better able to determine if an application will likely receive approval or denial. The committee
continued the discussion if the fees are in line with what is appropriate. It was determined that the
schedule should be looked at in the fall with the new Community Development Committee members.
Thompson explained that to change the fees now would affect the budget. Motion by Peavey, 2nd by
Marzolf that the committee accept the 2012 Land Use Ordinance Fee Schedule, and staff should add
the word `required' in front of the word `fee'. Also for the 2013 budget, costs need to be broken out
by staff time and other expenses. Sather questioned if the word `non - refundable' should be removed.
Kling recommended that it should not and reiterated that applicants are kept informed, and if a refund
is issued, it must be prior to the public hearing. Roll call vote on the motion: Marzolf — yes, Norton -
Bauman — yes, Peavey — yes, Sather — no, Hermsen — no. Motion carried.
Because no action was taken on agenda item #1, it was covered by the decision in agenda item #2.
Discuss Recreational Facilities in the Ag Res District: Discussion led by Chair Hermsen indicated
the long process that takes place to change permitted uses in the ordinance, and suggestions were
made that staff should work to get as many permitted uses in the Ag Res District to save work on the
Board of Adjustment. But changes in the ordinance to add more uses, should be considered when re-
writing the Zoning Ordinance, instead. Committee members stated that this recreational use would
benefit many citizens and be for the greater good, and asked if this use could be included as a Special
Exception in the Ag Res District. Kling presented four different options of how to proceed with this
request. Chair Hermsen clarified the intent of this discussion is to give direction to the new
committee coming in. The committee discussed the different options. Motion by Peavey, 2nd by
Norton - Bauman to instruct staff to develop wording for a petition to make these changes under option
#4 as a Special Exception, and bring it back to the committee. Peavey clarified that this only applies
to Towns in county zoning. Grabau explained that when a use becomes a Special Exception, then
anything zoned Ag Res can have these allowed uses. Motion carried.
ADJOURN: Motion by Peavey, 2nd by Norton - Bauman to adjourn the meeting at 5:30 p.m.
