L 0 irQ 06 4) St. Croix County, Wisconsin WHEREAS, St. Croix County has been experiencing an increase in illegal drug related activities, including the manufacture, possession, use and sale of drug related paraphernalia; and WHEREAS, a state statute now exists prohibiting such activities; and WHEREAS, St. Croix County law enforcement officers do aggressively enforce this statute; and WHEREAS, counties are authorized by statute to create an ordinance that mirrors the state statute; and WHEREAS, the time and expense of a county officer in making an arrest, transporting the subject to jail, performing the booking, evidence collection and preparing the state report is counter- productive to the amount of the forfeiture retained by the county. THEREFORE, the St. Croix County Board of Supervisors does ordain as follows by enacting this ordinance entitled: POSSESSION OF DRUG PARAPHERNALIA SECTION 1. "Drug paraphernalia" has the definition contained in Wis. Stats. §961.571 or any subsequent amendment thereto. SECTION 2. No person may use, or possess with the primary intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, inject, ingest, inhale or otherwise introduce into the human body a controlled substance or controlled substance analog as defined in Wis. Stats. §961.01(1). SECTION 3. Any person who violates this ordinance may be fined not more than $500 or imprisoned for not more than 30 days or both. IF SECTION 4. Any person who violates this ordinance who is under 17 years of age is subject to a disposition under Wis. Stats. §938.344(2e). SECTION 5. This ordinance shall take effect and be in force from and after its passage and publication pursuant to Wisconsin Law (effective the day after publication). Nelson, St. Croix County Clerk w • • •4 i AMENDMENT TO DRUG PARAPHERNALIA ORDINANCE NO. 608(2002) Ordinance No. !0 6 $' A St. Croix County, Wisconsin WHEREAS, Section 3 of St. Croix County Ordinance No. 608(2002) - Possession of Drug Paraphernalia - contains language allowing imprisonment of a person who violates the ordinance; and WHEREAS, a person cannot be imprisoned for violating a county ordinance; and WHEREAS, a person can be imprisoned for failure to pay a forfeiture imposed for violating a county ordinance. THEREFORE, the St. Croix County Board of Supervisors does ordain as follows: Section 3 of Ordinance No. 608(2002) - Possession of Drug Paraphernalia - is repealed and recreated as follows: SECTION 3. Any person who violates this ordinance may be fined not more than $500 and, in default of the payment of the fine, imprisoned in the St. Croix County Jail for not more than 30 days.
