CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG-RESIDENTIAL ORDINANCE NO. l a 3 (a (5o : ) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of JAMES AND MARGARET WOODRUFF on October 23, 2002, in the St. Croix County Government Center in Hudson, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED (Ag to Ag/Residential) Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. None of the site is in an environmental corridor. 3. Surrounding land uses include agriculture to the north, west and northeast and subdivision to the south and southeast. 4. The site has access to town roads to the north and east. 5. Proposed use is one immediate lot and a 6.5 -acre area, which will have a conservation easement to prevent further development. The applicant states that at this time the site will be a hobby farm. 6. The site has been laid out for a second lot in the future. The proposed conservation easement is located between the two lots to create a buffer. 7. The conservation easement area has been configured to allow a 200 -foot driveway separation between the driveway access for the future second lot and an existing driveway to the west. 8. Potential development of the site is two lots. 9. The applicant states that the Town of Troy did not require this rezoning to meet the whole farm plan requirements for the additional acreage across the town road. 10. The applicant states that site was reviewed under the Town of Troy's 50/50 Whole Farm Plan provisions in the subdivision ordinance. 11. Town of Troy has reviewed the rezoning and recommends approval, stating that they have considered §91.77. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 13.026 acre parcel in the Town of Troy is now rezoned from Agriculture to Ag-Residential.
