{ ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG. SIDENTIAL ORDINANCE NO. .9, Ca ao WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of LEE AND PATRICIA DORWIN on August 8, 2002 in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED: Ag to Ag/Res Based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. Site features include pasture, old cropland and an intermittent stream on the east side with some trees and woody vegetation. 3. The whole site has slight limitations for Private Onsite Wastewater Treatment Systems(POWTS). A perk test confirming sanitary treatment has been provided. 4. The surrounding land uses include large acreage farms, hobby farms of 40 acres and one small acreage parcel to the north of approximately 7 acres. 5. Site access is a town road. 6. Surrounding zoning is exclusive Ag all around. 7. Proposed development is one home site. 8. The potential buyer has indicated by letter that he intends to place a deed restriction/conservation easement on the property limiting development on this rezoned parcel to one building site. 9. Town of Baldwin has reviewed the rezoning and recommends approval, stating that they have considered §91.77. 10. The St. Croix County Natural Resource Management Plan Goals II, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. 11. The rezoning of this parcel is consistent with the County Plan. With the following condition: 1. A conservation easement/deed restriction is to be placed on the deed, limiting development on the property to one building site. This rezoning will not be approved by County Board until the deed restriction is submitted to and approved by the zoning director. The restriction will be required to be recorded on the new deed that will be created when the Certified Survey Map (CSM) is approved. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag- Residential.
