The St. Croix County Board of Supervisors does ordain as follows:
CHAPTER 20
LODGING AND FOOD PROTECTION
20.01. Authorization.
(A) Vending Operations.
(1) Pursuant to Wisconsin Statute sec. 254.69(1), in the administration and
enforcement of Wisconsin Statutes ch. 254, Subchapter VII (secs. 254.61
— 254.88), the Wisconsin Department of Health and Family Services
(Department) may use local health departments as its agents in making
inspections and investigations of vending machine commissaries, vending
machine operators and vending machines if the jurisdictional area of the
local health department has a population greater than 5,000. If the
designation is made and the services are furnished, the Department shall
reimburse the local health department furnishing the service at the rate of
80% of the net license fee per license year issued in the jurisdictional area.
(B) Hotels, Restaurants, Tourist Rooming Houses and Other Establishments.
(1) Pursuant to Wisconsin Statutes sec. 254.69(2)(am), in the administration
of Wisconsin Statutes Ch. 254, Subchapter VII (secs. 254.61- 254.88) or
sec. 254.47 (relating to campgrounds and camping resorts, recreational
and educational camps and public swimming pools), the Department may
enter into a written agreement with a local health department with a
jurisdictional area that has a population greater than 5,000, which
designates the local health department as the Department's agent in
issuing permits to and making investigations or inspections of hotels,
restaurants, temporary restaurants, tourist rooming houses, bed and
breakfast establishments, campgrounds and camping resorts, recreational
and educational camps and public swimming pools.
(2) A local health department granted agent status under this subsection (B)
shall establish and collect the permit fee for each type of establishment
identified in paragraph (B)(1). The local health department may establish
separate fees for preinspections of new establishments, for preinspections

of existing establishments for which a person intends to be the new
operator or for the issuance of duplicate permits. No fee may exceed the
local health departments reasonable costs of issuing permits to, making
investigations and inspections of, and providing education, training and
technical assistance to the establishments, plus the state fee established by
the Department for its costs related to setting standards under Wisconsin
Statutes Ch. 254, Subchapter VII (secs. 254.61 to 254.88) and sec. 254.47
and monitoring and evaluating the activities of, and providing education
and training to, agent local health departments. Agent local health
departments shall include the state fees in their permit fee, collect the state
fees and reimburse the Department for the state fees collected. For each
type of establishment, the state fee may not exceed 20% of the permit fees
charged under secs. 254.47 and 254.68.
(3) The St. Croix County Department of Health and Human Services (HHS) is
authorized to act as an agent of the Department in St. Croix County,
except in cities and villages that have a health department designated as an
agent of the Department, for purposes of:
(a) Making inspections and investigations of vending machine
commissaries, vending machine operators and vending machines;
(b) Issuing permits to and making investigations or inspections of
hotels, restaurants, temporary restaurants, tourist rooming houses,
bed and breakfast establishments, campgrounds and camping
resorts recreational and educational camps and public swimming
pools. A written agreement in conformance with Wisconsin
Administration Code Ch. HFS 192 shall be executed by and
between the Department and Public Health.
20.02. Regulations and enforcement.
The regulation and enforcement provisions applicable to the activities or establishments
identified in sec. 20.01 are contained in the following chapters of the Wisconsin
Administrative Code and they, and any modifications, are hereby adopted by reference:
1. HFS 172 — Safety, Maintenance and Operation of Public Swimming Pools.
2. HFS 175 — Recreational and Ed ucation Camps.
3. HFS 178 — Campgrounds.
4. HFS 195 — Hotels, Motels and Tourist Rooming Houses.
5. HFS 196 — Restaurants.
6. HFS 197 — Bed and Breakfast Establishments.
7. HFS 198 — Vending of Food.

20.03. Fees.
Annual permit fees, preinspection fees, and other fees authorized by law shall be
established by HHS. The fees shall cover the reasonable costs of the services. A written
schedule of fees shall be created identifying the types of facilities regulated and the
annual permit fee, preinspection fee, and any other fee for each type of facility.
20.04. Effective date.
This ordinance was enacted on the / 9 ' day of rr 1 ai-4. , 2002 but
shall not be published until the Department of Health and Family Services and the St.
Croix County Public Health office have entered into a written agreement. This ordinance
will take effect the day after publication.
