WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of JAKE P. CROWLEY on February 20, 2002, in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: The SE Y4 of the SW 'A, Section 26, T28N -R17W, Town of Rush River. Parcel contains 40 acres of land. Based on the following findings: 1. The parcel is in the rural planning area and is an appropriate use. 2. The land consists of open land with some trees planted. 3. Approximately 93% of the parcel is identified on the potentially productive agriculture map as prime farmland. 4. The parcel is not identified on the primary environmental corridor map. 5. The parcel has slight limitations for Private Onsite Wastewater Treatment (POWTS). The owners have perked the site and found two building sites. 6. The surrounding land uses are a mix of 40 -acre hobby farms and a few smaller acreages. 7. The land around the parcel is zoned ag /residential to the north and south and exclusive ag to the west and east. 8. The site is located at the intersection of a county and town road. 9. The proposed use of the land is two 20 -acre home sites. 10. Ag -II zoning would be somewhat compatible with the area. 11. Town of Rush River has reviewed the rezoning and recommends approval, stating that they have considered §91.77. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 40 -acre parcel is now rezoned from Agriculture to Ag II.
