RESOLUTION AUTHORIZING PURCHASE OF LAND
IN GOVERNMENT LOT 3, SECTION 28, TOWN OF ST. JOSEPH
(PERCH LAKE)

WHEREAS, a parcel of land adjacent to the County -owned land on Perch
Lake, approximately 30 acres, is available for purchase (more particularly described
on the attachment); and
WHEREAS, an access road to the County land could be built on this parcel
which would be about one -half mile shorter than the proposed access from the
North; and
WHEREAS, because the access road would be an interior park road it would
be eligible for 50 percent Department of Natural Resources (DNR) cost sharing; and
WHEREAS, approximately 20 acres of this parcel could be added to the
County Park, making the cost of the 20 acres eligible for 75 percent DNR cost
sharing; and
WHEREAS, an offer to purchase has been negotiated with the owners
(Seller) of the 30 acre parcel, James and Donna Onstott, the terms of which are as
follows:
1. Purchase price is $360,000, payable as follows: $1.00 upon acceptance
of this offer by the County Board; $115,000 at closing on August 1,
1997; $100,000 upon receipt of a DNR grant or on November 1, 1997,
whichever occurs first; balance upon the sale of the house on the
property by the County or on January 30, 1998, whichever occurs first.
2. Interest shall be paid to the Seller equal to that paid by the Seller for a
short term loan, estimated at 8.3 percent, not to exceed 8.78 percent,
applied to the outstanding principal balance from time of closing until
final payment. The County can prepay any or all of the balance due at
any time without penalty.
3. The following items shall be prorated at closing: real estate taxes,
garbage pickup and other private and municipal charges, and fuel. Net
general real estate taxes shall be prorated based on 1996 taxes.

4. Seller shall give evidence of title to the property in the form of an
abstract of title prepared by an attorney licensed to practice law in
Wisconsin or an abstract company. Seller shall pay all costs of
providing such title evidence. For purposes of closing, title evidence
shall be acceptable if the abstract is delivered to the County
Corporation Counsel not less than three (3) business days before
closing, showing title to the property as of a date no more than fifteen
(15) days before delivery of such title evidence to be merchantable,
subject only to liens which will be paid out of the proceeds of closing,
and standard abstract certificate limitations.
5. Upon payment of the purchase price, Seller shall convey the property
by warranty deed free and clear of all liens and encumbrances, except
municipal and zoning ordinances, recorded easements for the
distribution of utility and municipal services, recorded building and use
restrictions and covenants, and general taxes levied in the year of
closing, which constitute merchantable title for purposes of this
transaction.
6. Seller will comply with the real estate condition report requirement of
WB-1 1 Residential Offer to Purchase, if applicable to this transaction.
7. The following sections of WB-1 1 Residential Offer to Purchase shall
be applicable to this offer: Inspections; Property Damage Between
Acceptance and Closing; Preclosing Inspection; Default; Provisions
Related to Financing, for both the County and Seller.
WHEREAS, the following contingencies must be removed before the County
or Seller are obligated to close;
1. Approval of the terms of the offer to purchase by County Board.
2. Well and septic inspection and approval by County Zoning department.
3. Certification by Sellers that no hazardous waste has been stored on the
property.
4. Completion of repairs and improvements not marked "NO" as
described in the attached housing inspection report.
5. Approval of final terms and agreement by Seller's attorney.
6. Sellers obtaining financing for property and a residence near Dresser,
Wisconsin.
THEREFORE, be it resolved by the St. Croix County Board of Supervisors
that the terms of the offer to purchase are approved and that this transaction be
closed when all the contingencies listed above are removed.

Legal Description
• A parcel of land located in part of Government Lot Three (3) in the Southwest
Quarter (SW'/) of Section Twenty -eight (28), Township Thirty (30) North, Range
Nineteen (19) West, described as follows: Commencing at the South Quarter
corner of said Section Twenty -eight (28), said South Quarter corner being the
Point of Beginning of this description; thence North 00 °45'34" East, along East
line of said Southwest Quarter (SW'/), 1233.97 feet; thence South 88 °49'30"
West, 1148.19 feet to a point 8.5 feet, more or less, from the water's edge of
Perch Lake, said point being the Point of Beginning of a meander line along said
Perch Lake; thence South 05 °45'11" East, along said meander line, 103.55 feet
to a point 1.0 feet, more or less from said water's edge, said point being the end
of said meander ling; thence North 87 °54'49" East, 203.36 feet; thence South

Re: Existing Housing Inspection at 540 Perch Lake Rd.
Dear Mr. Fedroczi:
As per your request, the following is an explanation of the
aforementioned single family dwelling, as per onsite observation
of 5- 08 -97.
The home is approximately 11 years old. The entire exterior wear
surfaces of the house are in good condition and are showing signs
of wear properly with the age of their exposures.
•
The existing owner was wise not to have caulked the building
exterior at joints, windows and doors, until the building
components had shrunken and settled under due acclamation.
However, complete exterior caulking is in order now, including
the horizontal joint between the bottom of clapboard siding and
the exterior perimeter foundation insulation skirt sheathing.
Also, the existing finish sealer of the wooden clapboard siding,
and all exterior trim, is very nearly due for re- application.
As per ILHR /Comm. 21.04, exterior platforms at stairs, changing
D elevation 24" or greater, are required to have guardrails with 6" A'
maximum open spaces below, at 36" minimum height, and adjacent
stairs of more than 3 risers to have handrails at open sides,
30" - 34" height with 6" maximum open spaces below. These
measures should be implemented.
The roof cupola needs to be screened as birds are nesting
?S internally in the attic via roof access through same. I found no
evidence, externally or internally, of leakage or moisture
damages.
The house seems to be very well constructed, and finished in a
workmanlike manner.

The building interior shows minor shrinkage cracking at drywall
,4.) finishes and ceramic tile finish at 2nd floor toilet room. Same
is typical, and may be repaired by carefully caulking with
matching products.
Both first floor entry doors need sill /threshold adjustment, and
hinge fastening to substrate framing. All windows appear to work
well and appear to be free of moisture damages.
Interior stairs are required to have handrails as per 1 C)
aforementioned criteria, same should be installed.
As per ILHR /Comm. 21.09, 120 volt smoke detection is required at
each floor level, interconnected.
t? As exists, I did not find the lowest level smoke detector, and
the uppermost level unit is not working, thereby unable to
manifest interconnection.
The kitchen ceiling horizontal beams are separated at their
miter, above support post, and should be doweled or mechanically NO
fastened to prevent further joint compromise due to
normal /typical shrinkage.
There is no evidence of foundation failures or fatigue.
`..� The second story bathroom east wall electrical receptacle is not
working. The lowest level bathroom GFCI electric receptacle is
not working.
• The kitchen counter microwave receptacle needs its plastic cover
<<> fastened. I was unable to determine GFCI protection at kitchen
counter appliance receptacles within 72" of sink, in any
direction. GFCI protection is required at the kitchen sink area,
and should be implemented or verify protection.
As per ILHR /Comm. 82.40(5)(D)(3), the discharge piping from the
C5 water heater temperature and pressure relief valve is missing,
and should be installed to within 6" of the floor level.
The dishwasher and automatic clothes washer should have
mechanical water hammer arrestors installed as per ILHR /Comm. NO
82.40(8)(F).
Existing heating system is a gas fired boiler, and only
assumption may be made, that the system is properly sized and
properly working, same was not in demand status at the time of
inspection.
c) As per requisite to any home purchase, potential buyer should
verify utility costs for annual normal home function.

This house is unique in design, well kept, well built, and well
maintained, and with minor code compliant measures and normal
maintenance, will serve as a satisfactory single family dwelling.
The unattached garage is a well constructed building, and
reflective of the maintenance status of the house regarding
exterior caulking and exterior sealer finish. The existing
garage receptacles need to be GFCI protected.
This report is not representative of the private well or septic
systems status.

RESOLUTION TO ASSIGN A FULL TIME COMPUTER SPECIALIST TO THE
PUBLIC SAFETY COMPUTER PROGRAM
RESOLUTION NO.
ST. CROIX COUNTY, WISCONSIN
WHEREAS, the goal of the Public Safety Computer program is to
tie together all County law enforcement and related agencies,
providing accuracy, speed and safety in processing information.
WHEREAS, we have been successful in installing a Clues program
and related programs for the County and the municipalities of
Hudson and North Hudson.
WHEREAS, the Computer Services Department has supplied only a
part -time specialist, it has been necessary to assign a deputy
approximately 40% of the time to achieve adequate support.
WHEREAS, the plan to bring the Computer Services Department to
the equivalent of one full time person on 1 -1 -98 has been
cancelled.
WHEREAS, the Sheriff's Department will attempt to assign a
permanent one - quarter of a deputies time for computer support
starting 1 -1 -98.
WHEREAS, starting 1 -1 -98 there will be fewer personnel
supporting computer needs. These personnel shortages require that
the areas service be held at status quo. In other words, we cannot
accept new law enforcement agencies such as Baldwin, Glenwood City,
New Richmond, or River Falls.
NOW, THEREFORE, BE IT RESOLVED the St. Croix County Board of
Supervisors directs Computer Services to assign the equivalent of
a full time hardware and software specialist to permanently support
the Public Safety Computer Program. They should provide for this
in their 1998 budget. The goal of tying together all County law
enforcement units and related agencies can then be achieved.
