St. Croix County, Wisconsin
WHEREAS, St. Croix County is owed more than $400,000 in unpaid fines, fees and
forfeitures, and
WHEREAS, county collection efforts are hurt by the relatively high level of fees
charged by credit collection firms; and
WHEREAS, the state collects 90% of unpaid state fines, fees and forfeitures, thereby
eliminating any county collection incentive; and
WHEREAS, the unpaid fines, fees and forfeitures represent a revenue loss to the
county, thereby raising property taxes for all of the county's taxpayers; and
WHEREAS, the State of Minnesota through the revenue Recapture Act, Minn. Stat.
Chapter 270A, has implemented an effective system for collecting unpaid fines, fees and
forfeitures by deducting the unpaid fine, fee, or forfeiture from the individual or company's
income tax return; and
WHEREAS, the Minnesota Revenue Recapture Act provides for local units of
government, such as counties, to utilize this system at little or no cost;
NOW, THEREFORE, BE IT RESOLVED by the St. Croix County Board of
Supervisors recommend to the Governor and Wisconsin Legislature the adoption of
legislation creating a State and local government collection process similar to Minnesota's
Revenue Recapture Act and the implementation of this process by the Wisconsin
Department of Revenue;
BE IT FURTHER RESOLVED that this process be extended to unpaid property tax
assessments; and
BE IT FURTHER RESOLVED copies of this resolution be transmitted to Governor
Thompson, the Secretary of the Department of Revenue, the President of the Wisconsin
Senate, the Speaker of the Wisconsin Assembly, the County's legislative delegation and the
Wisconsin Counties Association.
