HomeMy WebLinkAboutResolutions 1995 (14) RESOLUTION OPPOSING NR135 NONMETALLIC MINE RECLAMATION RULES ST. CROIX COUNTY, WISCONSIN RESOLUTION NO. /4 (cf) WHEREAS, nonmetallic mining has recently been defined by State Statute as the extraction of rock, gravel, sand, clay, topsoil, peat, and other materials from the earth; and WHEREAS, nonmetallic mine reclamation has in the past been left under the control of local government; and WHEREAS, 1993 Wisconsin Act 464 mandates that counties adopt a nonmetallic mining reclamation ordinance in strict conformance to requirements set forth in Department of Natural Resources (DNR) administrative rules; and WHEREAS, Act 464 and NR 135, the proposed nonmetallic mine reclamation rules, dictates every facet of nonmetallic mine regulation to the local government; and WHEREAS, the rule is over prescriptive overburdens both mine owners and local government; and WHEREAS, the adoption of NR 135 will seriously increase the cost of nonmetallic minerals, such as gravel, due to the extensive permit and operational plan required and an expected reduction in mining activity; and WHEREAS, NR 135 does not appear to significantly benefit the residents of St. Croix County, but will definitely increase the cost of constructing and maintaining highways; and WHEREAS, the County believes that the State's concerns over nonmetallic mine reclamation could have been addressed without the overbearing, authoritarian approach taken by Act 464 and NR 135; and WHEREAS, the County is more than willing to work with the Wisconsin State Legislature and Department of Natural Resources to address nonmetallic mine reclamation in St. Croix County as a partner in government. THEREFORE, BE IT RESOLVED that the St. Croix County Transportation Committee hereby goes on record in opposition to NR 135 and 1993 Wisconsin Act 464; and FURTHER, BE IT RESOLVED that the St. Croix County Transportation Committee supports the repeal of 1993 Wisconsin Act 464 and the related ill conceived administrative rules (NR 135) and further supports replacement legislation which requires the mine operator and the county in which the mine is located to enter into a reclamation agreement satisfactory to both parties, thereby maintaining local control; and BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to Governor Tommy G. Thompson, our State Representatives and Senator, Department of Administration Secretary James R. Klauser, Department of Natural Resources Secretary George Meyer, and the Wisconsin Counties Association. Dated May 8th, 1995 at St. Croix County Wisconsin.
