Resolution 19 (95)
WHEREAS, St. Croix County has approximately 9502 existing
private sewage systems; and
WHEREAS, St. Croix County issues approximately 437 sanitary
permits annually for new and replacement sewage systems; and
WHEREAS, the local units of government are mandated by state
law to administer the state regulations for privately owned waste
water treatment systems; and
WHEREAS, the proposed ILHR 80 to 91 codes will change the
state /local public health and environmental protection concept from
an administrative code requiring long -term field tested soil
absorption systems to a performance code that may allow
experimental short -term tested or inadequately tested systems that
will not assure protection of public health or the environment on
a long -term basis in a cost effective manner, and
WHEREAS, the present existing ILHR 83 code developed through
University of Wisconsin research and public hearing process has
designed engineering, operation and management performance
standards into the present sewage systems; and
WHEREAS, the performance standards in the proposed code will
not adequately protect public health; and
WHEREAS, the proposed code does not design standards to insure
a reasonable lifetime or reasonable cost of installing or operating
a private sewage system; and
WHEREAS, holding tanks require a high level of local
enforcement trying to prevent raw sewage from being improperly
pumped or land spread in a manner which may pollute groundwater,
surface water and expose citizens to fecal material that transmits
diseases; and
WHEREAS, St. Croix County does not permit holding tanks on new
construction; and
WHEREAS, the total cost of a private sewage treatment and of
local code administration will be directly related to the new types
of private sewage systems mandated by DILHR without a public
hearing; and
WHEREAS, state law does not permit more restrictive
regulations governing private sewage systems to be adopted by local
government.
NOW, THEREFORE BE IT RESOLVED by the St. Croix County Board of
Supervisors, that the Board go on record opposing the Department of
Industry, Labor and Human Relations proposed Wisconsin
Administrative Rules chapters 80 through 91.
BE IT FURTHER RESOLVED THAT:
1. An environmental impact statement should be written to
determine if public health and the environment will be protected by
the proposed ILHR 80 through 91.
2. The existing ILHR 83 private sewage code should "not be
repealed at this time.
BE IT FURTHER RESOLVED that the County Clerk furnish copies of
this resolution to the Senate Legislative Committee on Urban
Affairs, Financial Institutions and Environmental Resources, to the
Department of Industry, Labor and Human Relations, to the
Department of Natural Resources, to the area legislators, the
Wisconsin Counties Association and to Governor Tommy Thompson.
