CROIX COUNTY BOARD OF SUPERVISORS RULES AND BY -LAWS - ZONING BOARD OF ADJUSTMENT Resolution No. 7 (9 5) St. Croix County, Wisconsin WHEREAS, St. Croix County Board of Supervisors Rules and By -laws provides for a Board of Adjustment to, in appropriate cases, make special exceptions and grant variances to the County zoning code; and WHEREAS, presently the Board of Adjustment is comprised of five supervisors appointed by the County Board Chair and Vice - Chair; and WHEREAS, sec. 59.99(2), Wisconsin Statutes, states: 1. The Board of Adjustment shall consist of no more than five members; 2. The members shall be appointed by the County Board Chair with the approval of the County Board; 3. The members of the Board of Adjustment shall serve for terms of 3 years beginning July 1; 4. The members of the Board of Adjustment shall all reside within the County and outside of the limits of incorporated cities and villages; 5. No members of the Board of Adjustment shall reside in the same town; 6. Office room shall be provided for the Board of Adjustment by the County Board; 7. The actual and necessary expenses incurred by the Board of Adjustment in the performance of its duties shall be paid and allowed as in cases of other claims against the county; 8. The County Board may compensate the members of the Board of Adjustment and the assistants as may be authorized by the County Board; 9. Vacancies shall be filled for the unexpired term of any member of the Board of Adjustment whose position becomes vacant; and �► WHEREAS, sec. 59.99 does not require members of the Board of Adjustment to be County Board supervisors; and WHEREAS, citizen members may improve the Board of Adjustment by reducing the possibility of conflicts of interest, increasing the size of the pool from which members may be drawn, providing expertise not otherwise available from supervisors, and may improve County Board efficiency by increasing the number of supervisors available for committee appointments; and WHEREAS, as of 1991, 48 counties in Wisconsin had no supervisors on their board of adjustment, 12 counties had membership made up of supervisors and citizen members, and 10 counties had all supervisor membership; and WHEREAS, St. Croix County believes that the composition of its Board of Adjustment should be changed so that 2 of the 5 members would be citizen members and 3 would be supervisors; and WHEREAS, St. Croix County believes that members of the Board of Adjustment should be compensated for service with the same per diem and mileage reimbursement that County Board supervisor's receive. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that Article IV, Section C of the St. Croix County Board of Supervisors Rules and By -Laws be and hereby are amended to read as follows: Section C. Board of Adjustment. 1. A Board of Adjustment is established pursuant to sec. 59.99, Wisconsin Statutes. It shall have the powers and duties delegated to it by the St. Croix County Zoning Code. 2. The Board of Adjustment shall consist of 5 members, 3 County Board supervisors and 2 citizen members. 3. The members shall be appointed by the County Board Chair with the approval of the County Board for 3 year terms beginning July 1. 4. The Board of Adjustment shall elect a Chair and a Vice - Chair. The Chair shall conduct the proceedings of the Board of Adjustment pursuant to its rules and by -laws. In the absence of the Chair the Vice -Chair shall so act. 5. The members shall be compensated for services by receiving a per diem and mileage reimbursement for each Board of Adjustment session at the same rates as County Board supervisors receive for County Board and committee meetings. 6. Vacancies shall be filled for the unexpired term of any member whose position becomes vacant in the same manner as appointments are made. FURTHER, be it resolved that the amendments to Article IV, Section C become effective immediately after the 1996 spring election and appointments to the Board of Adjustment are effective July 1, 1996.
