CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM COMMERCIALTg AG/ ESIDENTIAL ORDINANCE NO. 5 7 a Co c o ) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of KRISTEN A. GILBERTSON AND PAULETTE J. RICKARD on January 10, 2001 in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, voted to approve a rezoning of the following described land: A parcel of land located in the NE 1 /4 of the NW 1 /4 of Section 5, T31 N, R16W Town of Cylon, St. Croix County, Wisconsin, described as follows: Commending at the N 1 /4 comer of said Section 5; thence S0 °47'17 "W (assumed bearing referenced to the monumented North -South 1 /4 Section line) 664, 95' along said line; thence N89 °18'46"W 1010.28' to the point of beginning; thence S0 °26'31 "W 652.12'; thence Southwesterly 137.89' along the centerline of an existing Town Road on the arc of a 230' radius curve concave Southeasterly whose chord bears S68 °10'29 "W 135.83'; thence S51 °00'01 "W 120.34' along said centerline; thence Southwesterly 99.76' along said centerline on the arc of a 2Q0' radius curve concave Northwesterly whose chord bears S65 °17'21"W 98.72'; thence N0 °26'31 "E 823.32' along the West line of said NE 1 /4 of the NW 1 /4; thence S89 °18'46 "E 308.00' to the point of beginning, containing 225,405 square feet (5.17 acres) and being subject to existing Town Road right -of -way across Southerly 33' and being subject to an easement for electric transmission line, and being subject to all other easements, restrictions and covenants of record. Based on the following findings: 1. The Town of Cylon recommends approval of the request. 2. The land is in the rural planning area and is an appropriate use. 3. The parcel is identified on the potentially productive agriculture map. 4. The parcel is not identified on the primary environmental corridor map. 5. The proposed residential use of the land fits the policies of the County Plan. 6. The surrounding land uses include large lot residential and traditional farms. 7. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Commercial to Ag /Residential.
