HomeMy WebLinkAboutOrdinance 2001 (586) ORDINANCE AMENDING CHAPTER 17 g► ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTUR TO AG -II ORDINANCE NO. Q a WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to reviewpetitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of JOSEPH K. and JUDITH A. SIMON on June 6, 2001 in the Stanton Town Hall in New Richmond, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: SEE ATTACHED Based on the following findings: 1. The land is in the rural planning area and is an appropriate use. 2. Approximately half the parcel is good farmland and is identified on the potentially productive agriculture map. 3. The County Plan recommends that the farmland preservation area consist "of all parcels of 100 acres or more containing at least one -third of their area in potentially productive agricultural lands..." 4. The parcel does not conform to the 35 -acre minimum parcel size for the exclusive ag district. 5. The land to the south is a 400 -acre waterfowl production area. 6. Other surrounding land uses include small hobby farms and large active farms. 7. The proposed use of the land for one home site would be compatible with the surrounding land uses and fits the policies of the County Plan. 8. Further development is not possible in the Ag -II district. 9. The owners should be encouraged to identify the environmental features and to be aware of the limitations associated with these features. The environmental elements should be incorporated into the development. 10. As the owners consider design elements they should be encouraged to: protect the closed depression, floodplain and wetland; provide a 75 -foot buffer from wetlands, shorelands and closed depressions and use best management practices, erosion and sediment control and stormwater management for the shoreland. 11. The parcel existed prior to the adoption of the current ordinance and is considered a "parcel of record ". 12. The Town of Stanton as recommended approval of the request and considered §91.77 in making their decision. The request meets five of the six town criteria for rezoning to Ag -II, with the exception that the site has some Class II and III soils. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag -II. Dated this / y day of 9, , 2001. ST.
