ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG. -II ORDINANCE NO. .S"5 L @eel) WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to reviev petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of James W. and Mary E. Sander on May 16, 2001 in the St. Croix County Agriculture Center in Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A parcel of land containing approximately 40 acres located in the SE 1 /4 of the SE 1 /4 of Section 26, T28N -R17W, Town of Rush River, St. Croix County, Wisconsin. Based on the following findings: 1. The Town of Rush River has recommended approval of the rezoning request. 2. The request complies with the County Plan. 3. The request is compatible with the surrounding land uses, which include small hobby farms and large active farms. 4. The land is in the rural planning area and is an appropriate use. The proposed use is for one homesite. 5. Approximately half the parcel is identified on the potentially productive agriculture map. 6. Site has been converted to wildlife habitat mostly planted with deciduous and conifer trees. 7. Soil limitations likely preclude a second homesite on the property. 8. There were no objections to the request. 9. The Town and the County have certified that the provisions of §91.77 have been met. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag -II. Dated this 'C iL day of hn , 2001.
