CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO AG-RESIDENTIAL ORDINANCE NO. ,'cc' 5 (a 6 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of ROBERT MARTELL on August 22, 2001 in the Somerset Town Hall in Somerset, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: A 40 -acre parcel of land located in the SE 1 /4 of the SW 1/4, Section 16, T31N -R1 9W, Town of Somerset. Based on the following findings: 1. The Town of Somerset supports the rezoning request. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning generally conforms to the Town Plan. 2. The request generally conforms to the County Plan. 3. The Town and the County have certified that the provisions of §91.77 have been met. 4. The parcel is in the rural planning area and is an appropriate use. 5. The parcel is not identified on the potentially productive agriculture map. 6. Approximately half the site is identified on the primary environmentalcorridors map. 7. The site features include cropland, and heavily wooded areas. The site is located on a town road. 8. The environmental features include: woodlands and steep slopes. 9. The surrounding land uses include small acreages of 3 to 40 acres and two large acreage farms, one of which is a tree farm. 10. The applicant wants to rezone and sell the site as one parcel. Information on the proposed development was not provided. 11. The total potential development of the site is about 12 three -acre lot home sites. 12. The owners should be encouraged to preserve part of the environmental features and to be aware of the limitations associated with these features as part of the design of the site. The environmental elements should be incorporated into the development. 13. As the owners consider design elements, they should be encouraged to use best management practices, erosion and sediment control and stormwater management for the steep slopes and the closed depressions. 14. The St. Croix County natural Resource Management Plan Goals 1I, III and IV also encourages protection and preservation of surface waters and wetlands; fish and wildlife habitats; and agricultural land and soils to preserve ecological functions and recreational and scenic values and wildlife habitat. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the parcel is now rezoned from Agriculture to Ag- Residential.
