CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM A ORDINANCE ES O C COMMERCIAL WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Committee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is b review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of KENT WYNVEEN on October 3, 2001 in the St. Croix County Agriculture Center, Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, voted to approve a rezoning of the following described land: The North 209 feet of the South 1254 feet of the East 358 feet of the Southeast Quarter of the Southeast Quarter of Section 24, Township 29 North, Range 17 West, Town of Hammond. Parcel contains 1.720 Acres Based on the following findings: 1. The Town of Hammond supports the rezoning request 2. The request conforms to the County Plan. The action is consistent with the St. Croix County Land Use Management Plan. 3. The site is an existing commercial operation that was not identified on the Town of Hammond's original zoning map. The commercial use has existed for approximately 20 years according to the application. 4. The surrounding land uses include a commercial use to the south and farmland to the northeast and west. 5. The surrounding zoning is Commercial to the south and Ag/Residential to the north, east and west. 6. The site is located on State Highway 63 and is approximately a quarter mile from the Baldwin village limits. 7. Site features include a small piece of prime farmland and very poor soils for Private Onsite Wastewater Treatment Systems (POWTS). 8. Expansion of the commercial use is limited by the soils for onsite wastewater treatment and the nonconforming parcel size. 9. The zoning on this site should be corrected to avoid a non - conforming use situation. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 1.720 acre parcel is now rezoned from Ag-Residential to Commercial. • Dated this 3 d day of Ctl1 , 2001.
