} ORDINANCE AMENDING CHAPTER 17 ST. CROIX COUNTY LAND USE ORDINANCE REZONING LAND FROM AGRICULTURE TO A C S . - RESIDENTIAL ORDINANCE NO. 406 WHEREAS, the Statutes of the State of Wisconsin provide for a Planning and Development Canmittee to act in all matters pertaining to county planning and zoning; and WHEREAS, the St. Croix County Board has established the St. Croix County Planning, Zoning and Parks Committee; and WHEREAS, at the request of the County Board this Committee is to review petitions, hold public hearings, and present its recommendations for rezoning requests to the County Board for action; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee held a public hearing on the rezoning request of LYLE PALMSTEEN on October 3, 2001 in the St. Croix County Agriculture Center, Baldwin, Wisconsin; and WHEREAS, the St. Croix County Planning, Zoning and Parks Committee having considered all written information and verbal testimony presented at the hearing, and finding that the request meets the requirements of Wis. Statute 91.77, voted to approve a rezoning of the following described land: All that part of the Northeast quarter of the Northeast quarter (NE 1/4 of NE %a) of Section Five (5), Township Thirty-one (31) North, Range Nineteen (19), lying East of Lot 1 of Certified Survey Map filed December 16, 1976 in Volume "2" on Page 336. Parcel contains approximately 20 acres. Based on the following findings: 1. The Town of Somerset supports the rezoning request. The Somerset Town Plan uses five guidelines to delineate where preferred development areas shall be located. Based on the criteria in the plan, this rezoning conforms to the Town Plan. 2. The request generally conforms to the County Plan. 3. The Town certified that the provisions of §91.77 have been met. 4. The parcel is in the rural planning area and is an appropriate use. 5. The site is presently cropped. 6. Approximately 1/3 of the parcel is identified on the potentially productive agriculture map. 7. Approximately half the site is farmed, the other half is rolling and wooded. 8. Approximately Y4 of the parcel is identified on the primary environmental corridors map. 9. The environmental features include: Shoreland to a nearby wetland and 6 to 12 percent slopes. 10. Limiting soils for Private Onsite Wastewater Treatment Systems (POWTS) are found on a small portion of the site. 11. The surrounding land uses include large active farms, and a subdivision to the west. 12. Access to the site is from two town road. 13. Large lot development would be consistent with the rural character of the areas. 14. There is total potential development of approximately 6 lots. 15. The owners should be aware of the limitations associated with the environmental features. The area with soil limitation for POWTS should not be associated with a drainfield. 16. As the owners consider design elements, they should be encouraged to use best management practices, erosion and sediment control and stormwater management for the steep slopes; direct drainage away from the wetand. THEREFORE, BE IT NOW ORDAINED by the St. Croix County Board of Supervisors, meeting in regular session, that the 20 acre parcel is now rezoned from Agriculture to Ag- Residential.
