CROIX MEADOWS DOG TRACK PROPERTY INTO TRUST FOR THE BENEFIT OF INDIAN TRIBES Resolution No. 44 7 (q:3) St. Croix County, Wisconsin WHEREAS, a proposal has been submitted to the Federal Bureau of Indian Affairs (BIA) that would place the St. Croix Meadows dog track property into trust for Indian tribes for the purpose of allowing "casino- type" gambling on the property; and WHEREAS, if the BIA approves the proposal, Wisconsin Governor Thompson would also have to approve the proposal; and WHEREAS, land held in trust for Indian tribes is not subject to taxation and employee protection laws; and WHEREAS, transfer of the property into trust presents substantial benefits to the Indian tribes such that payments in lieu of taxes to St. Croix County and acceptance of employee protection laws by the Indian tribes is a responsible and proper acknowledgment of the benefits. THEREFORE, be it resolved by the St. Croix County Board of Supervisors that before approval of the transfer of the St. Croix Meadows dog track property into trust by the the BIA and Governor Thompson the following conditions be agreed to by the Indian tribes: 1. The BIA and the Governor shall not enter into or approve any agreements involving Indian tribes concerning gambling operations or ownership in St. Croix County until the County has received payment of any amount of real estate taxes, penalties, and interest due and unpaid on the St. Croix Meadows dog track property. 2. Any such agreements shall provide for timely payment of the following (payments in lieu of taxes): a. A sum equivalent to the real estate taxes which would be payable if the property were not exempt from taxation, which amount shall be payable as and when the real estate taxes would otherwise be due and not considered delinquent under the laws of Wisconsin. The payments will be adjusted as and when appropriate as if the property were not exempt from real estate taxes to account for any increases thereof that may result from changes in the mill rate or assessed value of the property. In no event shall the payment for any year be made on an estimated fair market value of less than $24,521,600 (1992 estimated fair market value). b. A sum equivalent to St. Croix County sales tax, paid at the then current rate, that would have been paid on any item or transaction if the property or operations were not exempt. c. A sum equivalent to any admission and head tax, or similar taxes, that would have been collected had the operations or property not been exempt, on each patron entering the facility for greyhound racing performances or to use casino gaming facilities or both, at the then current rate chargeable (presently $.25 per patron). 2 y r 3. Any such agreements shall contain provisions to ensure that the above payments will be made, including but not limited to performance bonds, and the obligation to make those payments is legally enforceable. 4. Any such agreements shall contain provisions accepting the applicability of the following to the Indian tribes: a. Employment laws, rules and regulations, including workers compensation, unemployment compensation, and the regulations and provisions of EEOC, ADA, ADEA, and OSHA. b. Construction and building laws, rules and regulations, such as DILHR regulations. c. Criminal laws of the State of Wisconsin and St. Croix County and the prohibitions on sales of alcohol and tobacco otherwise enforceable in the State and County. 5. Any such agreements shall require a general liability insurance policy to be obtained and continued. 3 , . . . ,.., , } FURTHER, be it resolved that the County Clerk send a copy of this resolution to Ada Deer, Secretary, Bureau of Indian Affairs, and Tommy Thompson, Governor, State of Wisconsin.
