HomeMy WebLinkAboutResolution 1992 (28) RESOLUTION DEALING WITH PROCEEDS FROM FORFEITED PROPERTY Resolution No. a (.f St. Croix County, Wisconsin WHEREAS, the Federal Government, Department of Justice, has in place a program whereby state and local law enforcement agencies may share in the proceeds from the sale of property which is forfeited upon the completion of criminal proceedings; and WHEREAS, the Department of Justice has developed policy guidelines to be used in the application for, handling of and accounting for proceeds which flow to state and local law enforcement agencies through this program; and WHEREAS, one of the guidelines of the Department of Justice requires that proceeds be used for specifically identified law enforcement purposes; and WHEREAS, St. Croix County may be able to participate in this program. NOW, THEREFORE BE IT RESOLVED by the St. Croix County Board of Supervisors that the St. Croix County Sheriff's Department be designated as the department to make application for proceeds; and BE IT FURTHER RESOLVED that the Public Protection Committee review and approve the law enforcement purpose for which the expenditure is being requested; and BE IT FURTHER RESOLVED that, notwithstanding the approved law enforcement purpose, if the actual amount received is less than the amount anticipated, authority to spend proceeds is granted as follows: 1. If the planned expenditure is less than $20,000, the Public Protection Committee must grant specific authority to spend such proceeds. 2. If the planned expenditure exceeds $20,000, the Public Protection and Finance 1 Committees, meeting together, must grant specific authority to spend such proceeds. A simple majority vote of the combined committees is required to approve the expenditure. The expenditure shall be administered by the Public Protection Committee. BE IT FURTHER RESOLVED that the Finance Committee is authorized to approve payment of vouchers related to the expenditure without further Board action. Dated this /4 day of , 1992.
