AMENDMENT TO ST. CROIX COUNTY CODE OF ORDINANCES
^WAEML LAND USE AND DEVELOPMENT CHAPTER 17 ZONING
SECTION 17.71 REZONING AMENDMENT
1 The St. Croix County Board of Supervisors does ordain as follows:

3 WHEREAS, the Schottler Family LTD. Partnership applied to St. Croix County Planning
4 and Zoning Department to rezone approximately 1.06 acres in the NE'/4 of the NW '/4 Section 19,
5 T30N, R17W, in the Town of Erin Prairie, from Agricultural District to the Agricultural Residential
6 District; and

8 WHEREAS, the St. Croix County Community Development Committee held a public
9 hearing on the rezoning request on August 16, 2012 in the St. Croix County Government Center,
10 Hudson, Wisconsin; and
11
12 WHEREAS, the St. Croix County Community Development Committee considered all
13 written information and verbal testimony presented at the hearing, and made the following findings
14 in support of the request:
15 1. The Town of Erin Prairie has recommended approval of this rezoning request.
16 2. The request is consistent with the St. Croix County Development Management Plan
17 and the St. Croix County Natural Resources Management Plan based on:
18 a. The parcel is in the rural planning area and is an appropriate use.
19 b. The proposed use is consistent with minimum lot size requirements in the rural
20 planning area.
21 c. The request is consistent with the surrounding neighborhood, countryside or
22 terrain.
23 d. The proposed use has minimal potential to adversely impact stormwater
24 management.
25 e. The proposed use has minimal potential to adversely impact water resources with
26 sedimentation resulting from erosion.
27 f The proposed use has minimal potential to adversely impact shoreland areas or
28 wetlands and closed depressions located in shoreland areas.
29 g. The proposed use has minimal potential to adversely impact closed depressions or
30 wetlands.
31 h. The proposed use is consistent with restricting development on slopes in excess of
32 20%.
33 i. The proposed use is consistent with policies to preserve woodlands, prairie
34 remnants, unique open spaces, or environmental corridors.
35 j. The proposed use is generally consistent with the County's policy to favor
36 agricultural uses over non-agricultural uses when considering land use conflicts.
37 k. The proposed use is generally consistent with the goal to protect and improve
38 groundwater quality to supply clean water for drinking and recharging surface
39 waters and wetlands.
40 1. The proposed use is generally consistent with the goal to protect and enhance
41 surface waters and wetlands to preserve their ecological functions and recreational
42 and scenic values.

43 m. The proposed use is generally consistent with the goal to protect and restore fish
44 and wildlife habitats for native species, improved water quality, recreational
45 opportunities, and natural beauty.
46 n. The request is generally consistent with the goal to preserve agricultural land for
47 crop production, scenic values, and wildlife habitat.
48 3. It appears that the proposed use can comply with standards in the Land Use,
49 Subdivision and Sanitary ordinances.
50 4. The proposed use is consistent with the spirit or intent of the Zoning Ordinance.
51 5. The request meets the requirements in WSS 91.48 (1).

53 THEREFORE, the following described parcel is hereby rezoned from the Agricultural
54 District to the Agricultural Residential District:

A parcel of land located in part of the Northeast quarter of the Northwest
quarter, of Section 19, Township 30 North, Range 17 West, Town of Erin
Prairie, St. Croix Cuuaty, Wisconsin, more particularly described as follows,
Commencing at the Northwest Corner of said Section 19, thence N87034'56"E.
along the north line of the Northwest quarter of said Section 19, a distance
of 1051,7~.fpet, to the pAnt of.beginning; thence continuing N87°34'56"E, a
distance of 66.70 feet; thence SO1°1B"55"E. a distance of 665,23 feet; thence
587°35'49"W, a distance of 72.03 feet; thence N40°51'24"W. a distance of
665.34 feet, to the point of beginning.
The described parcel contains 46,136 square feet [1.06 acresl, arrd is subject
