FINDINGS, CONCLUSIONS, AND DECISION
OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record
herein, and conducted an on-site inspection, the Board finds the
following facts:
1. The applicants are John B. and Michelle C. Mortel whose
address is 994 230th St., Baldwin, Wisconsin 54002
2. The applicant on March 10, 1997, filed with the Zoning Office
an application for a variance.
3. John B. and Michelle C. Mortel are the owners of the property
which is the subject of the application and is located in the
NE 1/4 of the NE 1/4 of, Section 17, T29N, R16W in the Town of
Baldwin, St. Croix County, Wisconsin.
4. The subject property is presently used for residence/hobby
farm.
5. Request is for an 8 foot variance from 230th Street. A
variance is required under Section 17.64(1)(d), town road
setback requirements.
6. The following exhibits were presented:
Exhibit 1: Copy of a survey map showing the property and
buildings.
Exhibit 2: Photo of the existing Mortel home and house plan
drawing.
Exhibit 3: Soil report with septic system by Art Weger.
Exhibit 4: Building plans with improvements
Exhibit 5: Warranty Deed
Exhibit 6: Correspondence from the Town of Baldwin supporting
this application.
7. John Mortel, being duly sworn, explained that when they
purchased their house in 1983 they had enough room for the
size of their family at that time. The house was two bedroom
when they purchased it, and their family has now grown to 5.
They would like to put on an addition, as the present space is
not adequate and they would like to have all of the bedrooms
on the main floor, rather than having the master bedroom in
the basement.
7. The Board visited the site and postponed a decision to allow
the Mortel's to present a case for the granting of the
.variance requested.
8. The application was again considered at the May 22nd meeting
under old business.
9. The Board found that the applicants have produced evidence of
a hardship in this case, and that evidence was presented in
Exhibit 1. Exhibit 1, a letter from the Mortel's with
supporting documentation, proved the hardship to be that due
to health reasons for both John and Michelle, a single story
home is necessary. The addition cannot be constructed
anywhere else due to a slope west of the home on the property.
The Board of Adjustment found that evidence given resulted in
a finding that special conditions existed at the site or
dwelling that would warrant the granting of a variance. The
Board of Adjustment found that special conditions or a
necessary hardship existed.
10. The Board found that granting of the variance would be
consistent with the spirit and intent of the zoning ordinance.
11. The Board of Adjustment finds that this variance application
does conform with the requirements for granting a variance.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and
the record herein, the Board approved the applicant's request for
a variance and has been approved on the following vote:

APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St.
Croix County circuit court within 30 days after the filing date
shown below, pursuant to sec. 59.694(10), Wisconsin Statutes. St.
Croix County assumes no responsibility for action taken in reliance
on this decision prior to the expiration of the appeal period. St.

Croix County does not certify that the identity of all persons
legally entitled to notice of the Board of Adjustment proceedings
which resulted in this decision was provided to the County.
If an appeal is taken of this decision, it is the responsibility of
the appellant to submit at his/her expense a transcript of the
Board of Adjustment proceedings to the circuit court, which is
available from Northwestern Court Reporters, Hudson, Wisconsin. It
is the responsibility of the Board of Adjustment to submit its
record (file) of this matter to the circuit court.
