The Application of: DECISION
George and Helen Weavers File No. 12-93
A hearing was held in the above referenced matter on May 27, 1993
before the St. Croix County Board of Adjustment, Chairperson
Bernard Kinney and members, Jerome Neuman, Robert Stephens, John
Bradley, and George Menter.
The applicants, George and Helen Weavers, whose address is 909
Highway 63, Baldwin, WI 54002 request a variance to section
17.64(1)(b)2 of the St. Croix County Zoning ordinance for the
following described parcel of land, which applicants own.
Location: The S, of the SW',, Section 18, T29,N-R16W, Town of
Baldwin, St. Croix County, Wisconsin.
The applicant proposes to construct a 9 foot by 15 foot addition
onto their existing residence. This addition would provide a
bedroom and bathroom on the 1st floor level.
The undue hardship which applicant claims a basis for the variance
is: Arthritic health conditions have made it impossible to climb
stairs to the bathroom and bedroom on the second floor.
FINDINGS OF FACT
1) The project is as described in the plans, showing a setback of
95 feet from the center of STH 63.
2) The required setback is 150 feet from the center of the road.
3) The existing residence is 89 feet from the center of the road.
4) The township of Baldwin supports the proposed setback.
5) A variance has been obtained from the Department of Industry,
Labor and Human Relations to allow the addition to be 2 feet
from an existing septic tank. The required code distance is
5 feet.

CONCLUSIONS OF LAW
The Board of Adjustment has the authority to grant variances as per
17.70(C)3 of the ordinances.
DECISION
Based on the finding of fact and conclusions of law, the
application of George and Helen Weavers for a variance is granted.

This decision expires after one year from the date of the decision.
If the proposal is not commenced within that time, a new
application must be submitted and approved before proceeding with
the proposal. If the proposal is not completed within that time,
an extension of the decision must be obtained.
This decision may be revoked by the Board, after notice and
hearing, if any condition of the decision is violated.
This decision may be appealed by any person aggrieved by the
decision by filing with the St. Croix County Circuit Court an
action for certiorari within 30 days of the date of filing this
decision. Applicant assumes all risk of relying on this decision
within the 30-day appeal period.
