Fisher explained to the Board that article number 8, Edward C. and Barbara Lyons/
Daniel Luckwaldt, will not be heard today. After reviewing the file, it was decided by the
Zoning Office that this special exception request was not needed. The applicants can
comply with the ordinance without a public hearing as the amount of mining to be done
is minimal and is within the ordinance standards.

226(89) (E) Applications and Permits (3).
Request:
The applicant is requesting to operate a Non-Metallic Mining pit in the
Ag/Residential District. The clay that is mined will be used to line an animal
waste storage pond on the Daniel Luckwaldt property. The applicant is
proposing to remove approximately 9,000 cubic yards of material and plans only
to use the site for two weeks.
According to the Nonmetallic Mining and Reclamation Ordinance 226(89) (E)
Application and Permits (3): a land use permit may be permitted by the
department if the operation will remove less than 10,000 cubic yards of material
from the site, the operation will be conducted for no more than 60 days, and the
operation will not be conducted in a major subdivision. The applicant has been
removed from the agenda and will be issued a land use permit for the borrow
site.

Dear Mr. Tiry:
This letter concerns the status of your permit application
referenced by the number above.
Without the additional information requested on June 4,
1999, we are unable to proceed with processing your application.
You responded by letter on July 2, 1999, indicating that you were
proceeding forward with the project and would send the requested
information. To date, we have not received that information.
Therefore, as provided by Corps regulations, we are
administratively withdrawing this application until sufficient
information is provided.
The application may be reinstated when the requested
information is submitted to us. It may be a violation of Federal
law to proceed with this proposal without first obtaining a
Department of the Army permit.
If you have any questions, contact Dan J. Seemon in our St.
